ARTICLE VII, Colonial Manor Apartment Complex
§ 239-42. Purpose.
The purpose of this Article is to regulate traffic on said complex pursuant to § 1640 of the Vehicle and Traffic Law of the State of New York.
§ 239-43. Regulations
A It shall be unlawful for any person to disobey the direction of any official regulatory traffic control device within or on the grounds of the Colonial Manor Complex, Barringer Road, Ilion, New York.
B It shall be unlawful for any person not authorized by law to park in handicapped areas to so park in said areas properly posted with New York State regulatory traffic signs.
C It shall be unlawful for any person to park a vehicle which does not bear valid license plates on the grounds of the Colonial Manor Complex property.
D It shall be unlawful for any person to park or let stand a vehicle on the following locations:
(1) In any location properly posted with regulatory signs restricting parking.
(2) In any zone properly posted as a fire lane.
(3) In any visitor zone when properly posted, if not a visitor.
(4) In any properly posted handicapped zone or parking areas.
(5) In any safety zone when properly posted as such.
E. It shall further be unlawful to violate any declared speed limit when proper signs are posted, any traffic control devices when properly posted and any turning moves when posted as is required by § 1640-a of the New York State Vehicle and Traffic Law.
§ 239-44. Penalties for offenses.
A. It is a traffic infraction for any person to violate any provision of this Article or regulations adopted hereunder, unless such violation is by the New York State Vehicle and Traffic Law or other law of this state declared to be a misdemeanor or a felony.
B. Every person convicted of a violation of any provision of this Article shall be punished by a fine as is defined under Part 1 of this chapter or by the New York State Vehicle and Traffic Law.
C. Every person convicted of a second violation within a period of eighteen (18) months shall be punished by a fine as is defined under Part 1 of this chapter or by the New York State Vehicle and Traffic Law.
D. Every person convicted of a third or subsequent violation within a period of eighteen (18) months shall be punished by a fine of not more than is defined by Part 1 of this chapter or by the New York State Vehicle and Traffic Law.
