1) Will of William Crumbleholme of Frome, [Cro0162] Somerset 1828

Extracted from the District Registry of the Probate Divorce and admiralty Division of Her Majestys High Court of Justice at Wells.

I, William Crumbleholme of Frome Selwood in the County of Somerset Painter and Guilder do hereby make publish and declare this my last will and testament in manner following that is to say I request that my body may be decently interred in the Church yard of the parish Church of Horningsham in the county of Wilts at the discretion of my dear wife Charlotte Crumbleholme . I give devise and bequeath all and singular my property of what nature or description soever and whensoever the same maybe situate including all monies due and owing to me at the time of my decease unto my friend George Porch of Frome Selwood aforesaid .......his Executors and administrators.

U pon the Trusts nevertheless and for the ends intends and purposes following: namely Upon Trust that he the said George Porch his executors administrators or assigns some or one of them do and shall immediately after my decease collect and get in all and singular the sums of money debts and accounts which may be then due and owing to me and do and shall sell and dispose of all and singular my stock in trade or of such parts thereof as maybe thought advisable and also such parts of my household goods and furniture plate linen and china as my said dear wife Charlotte shall not feel disposed to keep for the most money that can be obtained for the same allowing to her my said dear wife Charlotte full power to select such part and so much of my said household godsend furniture plate linen and china as she may find necessary and convenient .

And upon this further trust that the said George Porch his executors and administrators do and shall by and out of the monies so to be collected by him and to arise from such sale as aforesaid in the first place pay and discharge all and singular my just debts, Testamentary and Funeral expenses . And in the next place do and shall invest the residue thereof at Interest after such payment as aforesaid upon Government or real security and upon this further Trust that the said George Porch his executors or administrators do and shall permit and suffer my said dear wife Charlotte to collect and receive the dividends interests and annual proceeds to arise therefrom and the rents issues and proceeds of all and singular my messuage or public house and premises called or known by the name or sign of the Pack Horse Inn situate behind town in the parish of Frome Selwood aforesaid to and for her own sole use and benefit for and during the term of her natural life and for and towards her own support and maintenance and education of my dear children. And from and immediately after the decease of my said dear wife Charlotte. Upon this further trust that the said George Porch his executors and administrators do and shall sell and dispose of all and singular the said Messuage or public house and premises and all and singular other my property then remaining unsold and undisposed of by public auction for the best price and most money that can be obtained for the same.

And do and shall invest the monies to arise from such sale as aforesaid on good security and apply the interest thereof together with the interest arising from the money before invested by him or them for and towards the education and support of such and so many of my said dear children who may be then living under the age of twenty one years and unmarried . And do and shall divide the whole of the said principal monies so remaining invested after the decease of my said dear wife Charlotte between and equally among all and every of my said dear children who may be living as Tenants in Common and not as joint tenants the share of each child to be a vested legacy in him or her on his or her attaining the age of twenty one years or being married which may first happen with benefit of survivorship in case of the death of either of them dying under that age and unmarried to the others or other of them who may attain such age or be married as aforesaid it being my express wish that my said dear wife Charlotte shall enjoy and receive the income alone arising from the whole of my said property after deductions and payments aforesaid for the term of her natural life and that after her decease the whole of my said Estate and effects shall be divided between all my said children who may attain the age of twenty one years or be married in equal proportions as aforesaid and that the interest of the share of either of my said children under age or unmarried shall during his or her minority after the decease of my said Wife be advanced for and towards his or her education and support .

And lastly I do hereby appoint my said friend George Porch executor in trust of my said Willand guardian of my said children during their minority giving full power and authority to him the said George Porch his executor and administrator to dispose of all or any part of my said estate and effects and to do any act which may be for the benefit of my said dear wife and family in the arrangement of my worldly affairs . And I do hereby declare that the said George Porch his executors and administrators shall be at liberty to reimburse himself and themselves all expenses which he or they may be put unto in the execution of the trusts hereby reposed in him. And that his or their receipt or receipts shall be a good and effectual discharge to a purchaser or purchasers of all or any part of my said estate and effects. And moreover that the said George Porch his executors and administrators shall not be liable or accountable for any loss, misapplication or non application of any part of my said estate unless the same shall arise from his or their own wilful neglect or default .

In witness whereof I the said William Crumbleholme the said Testator have to this mt said last will and testament contained in three sheets of paper to the first and second sheets set my hand and to this last sheet subscribed my hand and affixed my seal this thirtieth day of January in the year of our Lord One thousand eight hundred and twenty eight (13/1/1828)
