This CSIF Brief shows that the International Institute for the Unification of Private Law’s (UNIDROIT) Principles on Digital Assets and Private Law (the Principles) aim to achieve high predictability in transactions and provide common ground and global legal certainty in the treatment of digital assets by unifying and harmonizing essential parts of private law. UNIDROIT recommends that each jurisdiction adopt rules that conform to these principles. In response, each jurisdiction may formulate laws and regulations that reflect the Principles.
この CSIF 概要では、国際私法統一協会 (UNIDROIT) のデジタル資産と私法に関する原則 (原則) が、私法の重要な部分を統一および調和させることにより、取引の予測可能性を高め、デジタル資産の取り扱いに関する共通の基盤と世界的な法的確実性を提供することを目指していることを示しています。UNIDROIT は、各法域がこれらの原則に準拠した規則を採用することを推奨しています。これに応じて、各法域は原則を反映した法律や規制を策定できます。
