More than 675,000 offenses, including hundreds of murder and rape convictions, have not been entered into Virginia’s main criminal record database because of missing fingerprints, according to a state report. Defendants were found guilty in almost 58 percent of the cases, according to the Virginia State Crime Commission report released Thursday that found sizable gaps in criminal records used by law enforcement and private employers conducting background checks on potential employees. The records are also used in gun sales and sex offender registration. The database—the Central Criminal Records Exchange—is also used throughout the criminal justice system to determine how offenders are punished based on their records.
This is the database that courts and police use to check a person’s prior record, often to determine what charge or sentence is appropriate. It’s a database that state police in Virginia, and around the country, use to determine whether someone is eligible to buy a gun. It’s what state agencies and employers check to see if someone has a conviction that might disqualify them from working at, say, a child-care center. It’s also the repository for fingerprints that investigators use when trying to match a print at a crime scene to a possible perpetrator.

As you know, DCJS has joined other agencies across the Commonwealth in their partnership with Fieldprint, Inc. to provide a statewide livescan fingerprint solution. This partnership will make the application process with DCJS faster and more efficient. Participation of applicants for licensure, registration and certification in this new process will not be optional. DCJS understands the need an adjustment period. Therefore, we will continue to manually process fingerprint cards that are received until June 1, 2018. After this date we will no longer be able to manually process fingerprint cards. If a fingerprint card is received, it will be returned to the applicant and they will be directed to the Fieldprint Virginia website.

All Virginia day care workers will have to undergo fingerprinting for a criminal background check after state lawmakers passed a bill intended to make sure the state doesn't lose out on federal funding. House Bill 1568 was designed to expand 'Camden's Law,' a bill passed in 2015 in honor of Camden Lafkin, who died when she was just three months old in May of 2012, while in the care of an unlicensed in-home childcare provider in the Shenandoah Valley. That law changed the requirements for child-to-provider ratios for unlicensed providers, as well as required licensed providers to be fingerprinted in a database starting in July of this year. The new bill requires unlicensed and license exempt providers who accept subsidies as tuition to do the same.
