The Division of Professions and Occupations and the Colorado Board of Nursing want to update you on the exciting progress we have made for nurses and applicants affected by enactment of SB 18-027, Concerning the enactment of the Enhanced Nurse Licensure Compact, on January 18, 2018. We have been notified by the Colorado Bureau of Investigation (CBI) that the Federal Bureau of Investigations (FBI) has approved Colorado’s fingerprint background checks. CBI is now ready to accept fingerprint submissions. The Board will continue to issue temporary permits until such a time that we are assured the fingerprint process is proceeding appropriately. This will ensure applications are processed timely and qualified nurses are authorized to practice nursing until their fingerprint background checks are processed. A man deemed mentally ill was incorrectly allowed to buy a gun last month because law enforcement agencies did not communicate fast enough to block the sale, Denver7 Investigates has discovered. The Colorado Bureau of Investigation agrees a 60-year-old man from Larimer County should have been prohibited from buying a gun after he was found mentally incompetent to stand trial in 2014. He was allowed to buy a gun in February anyway. The man was then allowed to hang on to the .44 caliber rifle for weeks, as it took law enforcement time to realize the mistake and then to find the man. He eventually gave up the gun and others he owned when his friend agreed to take possession of them.

Additionally, under 'Start Preparing Now,' all staff eighteen years of age and over (not under) will likely need to complete all background checks. We thank you for your patience and apologize for any inconvenience these errors may have caused. On September 30, 2018, new background check rule requirements will likely go into effect. These new rules are to better align background check requirements with Federal Child Care Development Block Grant (CCDBG) Regulations. Two vendors (IdentoGO and Colorado Fingerprinting) have agreed to provide sites—including mobile locations—across Colorado where citizens can obtain their fingerprints for background check purposes. The fingerprints will be directly submitted to the Colorado Bureau of Investigation (CBI) for processing. IdentoGO is currently offering fingerprinting services across Colorado. Colorado Fingerprinting has indicated their 'go live' date is scheduled for late October. We will provide updates as soon as we receive them.

Mandatory background checks stopped 7,227 would-be gun buyers in Colorado last year for reasons that ranged from the 31 people who had homicide records to the more than 1,300 people either arrested or convicted of assault. Another 252 actually had active warrants for their arrest when they attempted to buy guns. Even so, those denials only amounted to about 2 percent of the 360,468 gun sales screened by the Colorado Bureau of Investigations. CBI provides the “instant” background checks that gun sellers are required to use. It’s a high-volume job. There were 380,787 gun sales in 2016 and only 8,704 failed background checks -- also about 2 percent.
