Teachers getting arrested isn't just a Charlotte problem. It’s widespread. A Cleveland County high school teacher was charged with sex crimes with a student. In some cases, educators are hired even with arrest records. Charlotte-Mecklenburg Schools officials told Channel 9 they have made some major changes in the way they screen employees who work at schools.

Contained in the recently passed health-care reform bill, the National Background Check Program aims to help states and U.S. territories institute or make improvements to existing background check systems that screen individuals seeking jobs working with seniors in a long-term care setting. The program will release nationwide results, including use of an FBI fingerprinting system, on the criminal history of any potential employee who would have direct contact with vulnerable seniors. The program takes effect in 2010-2012 and will provide–to new program participants–a 3:1 federal-to-state dollar match not to exceed $3 million. For states already participating in the program, the match may not exceed $1.5 million. CMS will also provide technical support to all participants.

Last week's arrest of a Charlotte-Mecklenburg Schools substitute teacher, accused of sexually assaulting two young students has some parents asking how did he not raise red flags in the hiring process. John Rader joined CMS in 2016 as a substitute and taught in at least eight schools, including Merry Oaks Elementary, where his two accusers are enrolled. According to the CMS website, substitutes are required to have a Bachelor's Degree, pass a background check and submit three references from supervisors.

Beginning later this year, Centers for Medicare & Medicaid Services (CMS) will begin using a Fingerprint-Based Background Check Contractor (FBBC) to help keep patients safe through enrollment screening. This process will be put in place in order to comply with the implementation of the Affordable Care Act (ACA). The ACA requires that the Department of Health and Human Services establish screening procedures for providers and suppliers participating in federal health care programs.
