The move comes as groups across the country push “ban the box” initiatives, saying that job applicants who check “yes” to questions about past convictions don’t get called back for interviews. That makes it harder for those who have served time or otherwise paid for their crimes to improve their lives, perpetuating a vicious cycle, advocates say. Many states, cities and counties have ban-the-box laws prohibiting employers from asking initial applicants about their criminal histories. But no such laws apply to Duke, which is taking this step voluntarily.

The State System of Higher Education can't unilaterally require criminal background checks for faculty members who are exempt from such checks under Pennsylvania law, a Commonwealth Court panel ruled Wednesday. The decision marks a partial victory for the union that represents about 6,000 faculty at the 14 state-owned universities. The Association of Pennsylvania State College and University Faculties took the dispute to Commonwealth Court to force PASSHE to make the background checks the subject of contract negotiations.

It began with the Virginia Tech massacre ten years ago, when an English major on campus killed 31 people, wounding another 25 students and faculty before taking his own life. It remains one of the worst mass shootings in US history. Since that time, acts of lethal violence on college campuses around the U.S. have proliferated at alarming rates. Every year since Virginia Tech, at least one student has killed someone at their school, ranging from the relatively quiet single incident of a deadly student fight at Cornell in 2016, to a near epidemic in 2014, when sixteen separate lethal incidents occurred on U.S. campuses.

Different clearances are needed for different courses in the curriculum and instruction majors. For an up-to-date listing, visit https://ed.psu.edu/cife/clearances. Required FBI clearances include a fingerprint-based background check. Due to a recent change in the state’s contracts for fingerprint services in Pennsylvania, Penn State University Police will no longer be able to provide fingerprint services for University Park campus community members on the campus. However, services will still be available in State College. This is a statewide change. As of Nov. 28, the Pennsylvania Department of Human Services has transitioned from its former provider, Cogent, to security and identity company Idemia to process fingerprint-based FBI criminal background checks. Idemia's fingerprint service provider, IdentoGO, declined to offer on-campus fingerprinting services.

The recent allegations against former Christopher Newport University football player Jesse Matthew Jr. have raised questions about the amount of background information colleges retrieve on students and how they share it with other universities and law enforcement. Matthew, who was previously accused of a sexual assault at Liberty University, was also the subject of a criminal sexual assault investigation that was never prosecuted at CNU. He is now charged with abduction with intent to defile in the case of missing University of Virginia student Hannah Graham. State law requires public and private colleges to submit the names of all students they admit to Virginia State Police to check against a national list of convicted sex offenders and the Virginia Criminal Information Network.
