CPS conducts background checks on prospective teachers, volunteers and contract workers to ensure they have not committed an offense on a long list of “enumerated crimes” that would bar them from city schools. But the district has not effectively checked for arrests and convictions that occur after the person is already employed, the Tribune found. Illinois has a “rap-back” system that allows state police to check lists of fingerprinted school employees and notify school districts of convictions. But CPS told the Tribune “there have been instances where this notification process was insufficient.”
Even when applicants are screened, investigators found that the Park District does not check for criminal offenses that took place outside of Illinois. As a result, last year the Park District approved a volunteer applicant who had been convicted of misdemeanor sexual assault in another state. (The person did not end up volunteering with the Park District, according to the report.) The Park District processes close to 1,000 applications for volunteers each year, said Will Fletcher, the Park District’s inspector general. But of the eight parks reviewed by Fletcher’s office, the Park District did not conduct criminal background checks on nearly a third of active volunteers, leading to a handful of instances where applicants with potentially disqualifying criminal records made it through the vetting process, Fletcher said.
An in-progress report from a background screening firm revealed a misdemeanor conviction for driving under the influence and two separate drug-related felony convictions. A more comprehensive report including the same criminal findings was delivered by the screening company a week later. Upon revoking its job offer, Lincoln only sent the partial report to the applicant, believing it met adverse action requirements as illustrated by the FCRA. However, the candidate argued that the employer violated FCRA rules "by taking adverse employment action based on a consumer report without first providing (to him) a copy of the pertinent consumer report." The applicant also said he was not given enough time by Lincoln to contest the report before adverse action was taken.
CHICAGO (Reuters) - Illinois Governor Pat Quinn signed a gun-control measure into law on Sunday that expands background checks to cover all firearms purchases in the state, closing what he said was a loophole that exempted gun sales between private parties. The new law also requires all gun owners to report any lost or stolen firearms to local police within 72 hours. “Guns are a plague on too many of our communities,” Quinn, a Democrat, said in a statement. “Making sure guns do not fall into the wrong hands is critical to keeping the people of Illinois safe. This commonsense law will help our law enforcement crack down on crime and make our streets safer.”
