Governor Terry McAuliffe on Friday signed an executive order making Virginia the latest U.S. state to prohibit government employers from asking job applicants about their criminal history. Virginia joins more than a dozen other states in its decision to “ban the box” on job applications that prospective employees are asked to check if they have been convicted of a crime. An individual’s rap sheet may be considered only if it “bears specific relation to the job for which they are being considered,” such as child care workers, state troopers, court officers and jail guards, said gubernatorial spokesman Brian Coy.

The VDSS has contracted with Fieldprint, a national provider of fingerprinting services with more than 30 locations in Virginia, including one on State Farm Boulevard in Albemarle County. If the Virginia State Police or the FBI finds that someone has a criminal record, the VDSS Office of Background Investigation determines if they have committed a “barrier crime” that would prohibit them from working with children. The required background checks cost $57 for employees, applicants, agents, caregivers, approved providers in a family daycare system, and household members living with home-based daycare providers. Volunteers pay $38 for the background checks.

Now, after the incident was reported to a child protective agency as part of Cloverpatch's standard procedure, Bruscino is listed as "indicated" for child neglect on the state's Central Register of Child Abuse and Maltreatment. Unless a court overturns the state's decision, her name could remain there for about 25 years. In teaching circles it's the equivalent of a scarlet letter that will show up anytime a school or child-care provider runs an employment background check.

The cost of fingerprinting has been determined. The total cost will cover fees for Fieldprint, Virginia State Police, FBI, and Office of Background Investigation (OBI). Employees, foster/adoptive parents, relative placement/kinship foster, birth parents, household members = $57.00

NOTE: The fingerprinting is replacing the VA State Police Criminal Record Check ($15/$20) only. Individuals will still need to complete the Sworn Affirmation and obtain Child Protective Services Check of the Central Registry ($10)
