(Reuters) - Governor Terry McAuliffe on Friday signed an executive order making Virginia the latest U.S. state to prohibit government employers from asking job applicants about their criminal history. Virginia joins more than a dozen other states in its decision to “ban the box” on job applications that prospective employees are asked to check if they have been convicted of a crime. An individual’s rap sheet may be considered only if it “bears specific relation to the job for which they are being considered,” such as child care workers, state troopers, court officers and jail guards, said gubernatorial spokesman Brian Coy.

Employers need to remember that while they may disqualify employees on the basis of criminal background checks, such disqualification cannot be applied in a discriminatory way. Having a uniform background check procedure that complies with state law isn’t enough; the company’s policy also has to comply with complex federal and EEO laws. On January 19, 2018, the Virginia Senate voted 23 to 16 to prohibit the State from asking on employment applications about previous criminal arrests and/or convictions. The philosophy behind the “ban the box” laws is that an applicant’s qualifications must be considered in employment decisions first and foremost due to the stigma associated with a criminal record. “Fair chance” initiatives also allow an applicant to proceed with their application process without having to answer any questions on the application about previous criminal arrests and/or convictions.
