In some states, organizations are required by law to scrutinize hires interacting with children and other vulnerable populations. Concerns about child welfare have tightened background screening laws nationwide. In Georgia, for instance, all employees of licensed child-care facilities must undergo a state and federal criminal records check and obtain a "satisfactory determination" from the Georgia Department of Early Care and Learning (DECAL). Beginning January 1, 2019, every child-care worker will need a records check issued by DECAL within the last five years, with a new fingerprint background check required every five years thereafter.

In a 2017 request for proposals to provide the statewide fingerprinting services, the VDSS estimated that it would process 80,000 to 100,000 background checks in the first year of implementation. The department is updating the clearance of current employees on a staggered schedule based on when they last completed a standard background check. Lovelace said the background check prices include the fees charged by the VDSS, the FBI and the Virginia State Police, plus an $8.72 surcharge from Fieldprint. The background checks must be completed before starting a new job or volunteer commitment at a childcare center, and must be updated every five years.

The criminal background and fingerprint checks gradually will expand to include all existing day care employees by the end of 2015, according to Sheree Powell, Department of Human Services spokeswoman. “It's going to be great as far as the safety of the kids in our state is concerned,” said Kathy Cronemiller, president of the Oklahoma Child Care Association. Registered sex offenders are banned by law from working in day care facilities. DHS also has policies that prohibit people convicted of certain violent crimes and drug offenses from working in day cares, although waivers sometimes have been granted depending on the crimes and circumstances. State criminal background checks through the Oklahoma State Bureau of Investigation have been required in the past, but they did not necessarily catch day care employees who moved to Oklahoma after having committed crimes in other states. Such employees often would lie about their out-of-state criminal behavior on their applications.

New requirements for child care providers in North Dakota begin October 1st. The North Dakota Department of Human Services will implement two additional federal requirements to become a regulated and licensed child care provider. The first change will require all child care staff regardless of age or position to complete a comprehensive fingerprint-based background check. This will also include any volunteers who may have unsupervised access to children. The second requirement is that no new staff members will be able to begin work until the department reviews their Bureau of Criminal Investigation (BCI) or their national Federal Bureau of Investigation (FBI) criminal criminal history records. Neither of these two new rules, are currently happening in the state but will be enforced at the beginning of October. Supervisor of the Criminal Background Check Unit for Children and Family Services, Tara Reed, says, "The goal is to help ensure the safety and protection of children that are receiving childcare or attending child care throughout the state of North Dakota."
