The California Supreme Court has upheld a state law that requires employers to obtain workers' permission before hiring a company to check their backgrounds. The court in a unanimous ruling on Monday rejected an argument that the law was unconstitutionally confusing because it overlapped with another law that doesn't require employee consent. The justices said employers could follow both laws. The ruling came in the case of a bus driver who filed a lawsuit alleging her employer, First Student, Inc., did not obtain her written consent for a background check as required.

The court had to consider whether ICRAA was "unconstitutionally vague" when applied to employee background checks because it overlaps in part with the Consumer Credit Reporting Agencies Act (CCRAA), which does not require prior disclosure or consent from an employee. First Student had complied with CCRAA requirements. The court ruled that overlap between the two statutes does not render ICRAA vague, and that even when CCRAA applies, that fact does not exempt an employer from ICRAA background check requirements.

Ridesharing company Lyft said Wednesday that it’s beefing up its background checks after a driver arrested for rape was found to be in the United States illegally. The company’s “enhanced detection processes” will apply to new applicants and existing drivers, Lyft spokeswoman Kate Margolis said. She declined to discuss the changes in detail. Uber and Lyft hire private background companies that run a driver’s name, license and Social Security number through local court records, national criminal databases and a federal sex offender registry. Searches can take as little as 24 hours, and none would flag a worker in the country illegally using bogus documents.

According to the complaint, Lee and Campbell applied to work at rental car locations in California owned by Hertz. As part of the hiring process, Hertz obtained criminal background checks about both named plaintiffs after providing a disclosure of its intent to do so and securing authorization from each. Lee and Campbell each had a criminal incident on their background checks, which were apparently reported accurately, and each alleged that they were subsequently denied employment with Hertz as a result. Both claimed that Hertz violated the FCRA by failing to provide a clear and conspicuous standalone disclosure of its intent to procure a consumer report and by failing to provide pre-adverse action notice, and a copy of the underlying report, before taking adverse action.
