In 2010, the Mississippi legislature granted the statutory authority to perform criminal background checks. Mississippi Code Ann. Section § 73-15-19 (1) and 73-15-21(1) authorizes the board to conduct a fingerprint- based criminal background history check of the Mississippi Criminal Information Center (MCIC) and the Federal Bureau of Investigations (FBI) criminal history data base on all applicants for licensure. In addition, the board, upon reasonable suspicion that a holder of a license has violated any statutory ground for denial or is guilty of any offense in Section 73-15-33, require the licensed nurse to undergo the same form of criminal background check.
