Biography

This is the profile for the daughter of Andrew Lane who married William Orcutt.

Parentage

The fact that a daughter of Andrew Lane and Triphena (Unknown) Lane married William Orcutt is established by an agreement dated May 10, 1675 in which the sons and daughters and sons-in-law of the late Andrew Lane agreed that their mother "Triphenie Lane" should have the use of all of his estate as long as she was a widow. The agreement is signed by, among others, William Orcutt, which establishes that William had married one of Andrew and Triphena's daughters.[1][2]

Did William Orcutt have Two Wives?

Since there is a record of the baptisms on August 16, 1646 of Mary, Abigail and Andrew, children of Andrew Lane,[3][4] and no baptismal record has been found of any other daughter of Andrew Lane who could have married William Orcutt, it is generally believed that William married the Mary Lane who is referenced in that 1646 baptismal record. The only record, however, that mentions the first name of William Orcutt's wife is a December 1693 distribution agreement with respect to William's estate, which says that his wife's name at the time was Martha.[5][4][6] Since Martha is not known to have been a common nickname for Mary (or vice versa), this has led some genealogists to conclude that William married, first, Mary Lane, who may have given birth to some or all of his children, and then married, second, a woman named Martha, who may have given birth to some or none of his children.

The consensus among the most knowledgeable Orcutt genealogists (including Helen Judson in the 1960s and Christopher Child in 2015), however, is that it is likely that Martha was William's one and only wife. The evidence given for that position is that (1) the 1693 administration papers for William Orcutt's estate refer to William's children as also Martha's children[5][4][6] and (2) in the July 1675 probate agreement regarding Andrew Lane's estate, William Orcutt appears to be signing on behalf of a living daughter of Andrew Lane and there is no evidence that the Lane daughter he had married was deceased.[4][6] Further evidence that Martha was William Orcutt's only wife is provided by the fact that his first-born daughter was named Martha. It is plausible that (1) the 1646 baptismal record for Mary relates to a Mary Lane who died young (and thus not accounted for in her father's July 1675 probate agreement) and the baptismal record for Martha Lane has not been found, (2) the 1646 baptismal record relates to Martha Lane but her name was incorrectly recorded or transcribed as Mary, or (3) Mary was an alternative name used for Martha Lane, at least when she was an infant.

The remainder of this profile assumes that William Orcutt had only one wife and that the daughter of Andrew Lane who married William Orcutt is the same person as his wife Martha who is mentioned in his estate papers.

Date and Place of Birth

While it is reasonably likely that the August 16, 1646 baptismal record relates to a Mary/Martha Lane who married William Orcutt, her date of birth is uncertain. Besides Mary, two other children of Andrew Lane were also baptized that day: Abigail and Andrew. While it is generally assumed that children were baptized shortly after their birth, in this case, it appears highly likely that the children were not triplets and that at least two of the three were baptized long after their dates of birth. "Lane Genealogies" provides an August 11, 1642 date of birth and a December 27, 1665 date of marriage for Abigail.[7] Apparently based on the fact that Mary/Martha was married about two years before Abigail (see below), the "Lane Genealogies" estimated Mary/Martha's date of birth as 2 years before Abigail's, or about 1640.[7] This appears to be a reasonable estimate.

Since Mary/Martha's parents were residents of Hingham in 1640 and she was baptized there, it is reasonably certain that she was born there.

Marriage

The Hobart Journal of Hingham contains an entry under the heading for December 1663 which states that " 24 Andrew Lanes Daughter Maryed," thus indicating that the marriage occurred on December 24, 1663.[8][9] This marriage record has reasonably been construed to be a record of William Orcutt's marriage to Andrew Lane's daughter Martha/Mary.[4][6][9] The date is consistent with the fact that William's oldest child was probably born sometime in 1664-5. "Lane Genealogies,"[7] "History of Hingham"[10] and some other sources[4][6] state that William and Martha/Mary were married on January 23, 1663/4; however, this appears to be a misreading of the Hobart Journal, perhaps due to the fact that the "December" heading is on the bottom of the prior page.[8][9]

Death

Mary/Martha's husband, William Orcutt, died on September 14, 1693.[16] An agreement was entered into on October 11, 1693 between Mary/Martha and her sons and daughters regarding the distribution of his estate.[16] Mary/Martha therefore died sometime after that date. Her sons Andrew, Benjamin and Joseph settled in Weymouth,[17] and it is reasonably plausible that Mary/Martha moved there sometime after her husband's death. There is a record of the death in Weymouth on April 30, 1712 of Widow Orcutt,[18][19] which the "History of Weymouth" reasonably suggests was probably for the widow of William Orcutt.[17]

CAUTION: It is traditionally held that William Orcutt had two wives, one wife being the Mary Lane mentioned in a baptism of Andrew Lane's children, as William Orcutt appears to have been a son-in-law of Andrew Lane; and the other wife named Martha who appears as his widow in a probate documents and an agreement of heirs. There is also speculation there was only one wife, though such a theory requires repudiating a contemporary record. (For more details, see this discussion). William Orcutt has been entered into WeRelate with two wives on this page so his page is recognizable to people reading the literature. However, the assumed 2nd marriage could have happened anytime between 1668 and 1693 and so it is impossible to make any case for allocating children that isn't pure guesswork. For that reason, all his children will be consolidated on his family page with Mary Lane in order to most clearly represent their relative birth order and spacing. It is known that many people will regard this as incorrect, but until additional primary evidence can be brought forward to provide proven answers, and given the current WeRelate practice of discouraging duplicate parents, it seems the best way to keep information on this/these families centralized and unduplicated.

William Awcotte, son of John Awcotte/Alcock, was baptized in Mancetter, Warwickshire, England on March 23, 1605.[1] As discussed in his father's profile, the identity of his mother is unknown.

The William Awcotte who was baptized in Mancetter in 1605 is almost certainly the William Alcock/Alcocke/Alcoate who had children baptized in Mancetter in 1637-1656, as it appears that the spelling of all his siblings also changed in the Mancetter records from Awcotte to Alcock or a variant thereof by 1620.[2]

Spouse; Marriage

The baptismal records for William's children list their mother's name as Margaret. The fact that their eldest known child was baptized in December 1637 suggests that William and Margaret were probably married sometime in 1636-7. Based on the fact that William and all of his children were baptized in Mancetter, it is reasonably probable that William and Margaret were married there or in a nearby parish in Warwickshire. According to research reported by Joel Thomas Orcutt, there is a record of a marriage between a William Aucott and a Margaret Bickley in June 1635 in Whitacre, Warwickshire[3] or April 1636 in Over Whiteacre, Warwickshire[4] that is probably a record of the marriage of this profile's William Awcotte and his wife Margaret. As of July 2018, however, no copy of the record of this marriage (or any other marriage in Over Whitacre parish during that time period) appears to be available online.

Death

William's date and place of death are uncertain. Some family genealogies state that he was buried in Mancetter on March 5, 1673/4. However, the Mancetter parish entry on which that claim is based fairly clear does says "William Evrett" not "William Orcutt" as has been claimed, and, in fact, has been indexed by findmypast.com as "William Everett."[14] In the absence of further evidence, all that can be said is that William probably died sometime after 1655 and that it is reasonably likely (but uncertain) that he died in Mancetter.

"J.T. Orcutt argues that William Orcutt is the William Alcork, son of William and Margaret, baptized at Mancetter, Warwickshire, 29 October 1639. This William's parents are treated in an article by Mary Locke Eysenbach, "Alcocks of Maine, Massachusetts, and New Hampshire ... New Hampshire Genealogical Record 26 (2009) 49-57"[15] JT Orcutt wrote Or Orcutt Family. 2001 and the English Origins of the Orcutt Family (2008). These contain transcriptions of the parish registers and are available at the Family History Library. Orcutt History, Family Crest & Coats of Arms

The Orcutt surname is derived form the Old English word "ortgeard," or "orceard," a compound of "wort," or "plant," and "geard," meaning "yard." It is thought to have originally been a topographic name for someone who lived by an orchard, or perhaps an occupational name for a fruit grower. There were also several places named Orchard, such as those in Devon and Somerset, and the surname may have been taken on from a place name.

Early Origins of the Orcutt family

The surname Orcutt was first found in Devon, where they held a family seat as Lords of the Manor of Hartland Abbey in that shire.

"The barton, [of Mitchell-Morton, in the parish of Launcelles, Cornwall] belonged for many years to the Orchard family, is now vested in the Rev. Thomas H. Morrison, as devisee of the late Paul Orchard, Esq."

Although the origin of this name may seem obvious to most, the real source lies far from fruit trees. Far to the north, the Urquharts were hereditary Sheriffs of Cromarty. This difficult Gaelic name posed problems for even the Scottish tongue.

In Loch Ness, Scotland, their seat, they were frequently called Orchar or Orchard. Hence, the name Orchard earned the right to be a sept of the great Clan Urquhart. In the 14th century it is generally believed that a branch of this clan moved south to Devon and became seated at Hartland Abbey.
