E-Verify is a web-based system that allows employers to electronically confirm if their new hires are eligible to work in the United States. It does this by comparing information from an employee's Form I-9, Employment Eligibility Verification, to records from the U.S. Department of Homeland Security (DHS) and Social Security Administration (SSA)
NG staff with access to E-verify (as of 4/29/24): Barb, Maija.
Employees with E-verify access should be familiar with most recent version of the E-verify user manual. Initial and refresher training needs to be completed before using E-verify.
Must ensure that all personal information collected is safeguarded and used only for the purposes outlined in the MOU.
Must notify all employees of our participation in E-Verify. Posters: "E-Verify Participation" and "Right to Work".
Can't use E-Verify to pre-screen an applicant. Can't use it for an employee hired before we signed the E-Verify MOU.
Must use E-Verify for all new employees once signed E-Verify MOU (4/29/24).
Create case in E-Verify only after the applicant has accepted an offer of employment and Form I-9 is complete. Also must give notice about participation in E-Verify and their rights. Protect privacy of employees. If there is a mismatch, provide them with the printed Further Action Notice.
No discrimination - treat all applicants/employees the same regardless of immigration status etc.
You can't terminate an employee because of the mismatch until it becomes a Final Non-confirmation.
Make sure they have a social security number.
Non-US workers: see this page
On the first day of work, you need to enter information into Gusto to confirm employment authorization. Gusto will also automatically produce the I-9 forms.
