Christmas, Hanuka and Eid is a time when we think more of others than of ourselves.

Perhaps it’s the only time of the year when it's imperative that we are not selfish

Yes it’s Christmas, its also Hanuka and soon Eid, Yes we should be thinking more of,

the more vulnerable, the frail and the more dependant

These people and especially the children, should receive our greatest compassion around Christmas, Hanuka and Eid .

Tonight i invited Matt Awad once again to comment on a hypothetical scenario,

titled : The distance or a divorce that separates Kids from the other parent, especially around Christmas, Hanukah and Eid.

An Australian female that falls in love with a foreigner, whilst she was on holidays/working O/S, gets married, arranges all Australian papers to have him settle with her in Australia, they have their first child and he gains his Australian Passport,

The father has difficulties in keeping long term employment and with the on-set of Mental Health issues [ Diagnosed in Australia ], the marriage frays

Soon after their good news of the birth of their 2nd child, the mother experiences Post Natal Depression,

The foreign grandparents travel to Australia, stay for six months and then

offer to look after their newly born baby, taking the baby back with them O/S,

while the father accepts treatment for Mental Health and battles with his behavioural issues in Australia

The 2nd Child is now 6 months old, is allowed to travel, is issued with an Australian Passport and travels back with the grandparents to O/S

The grandparents applies and is issued a foreign passport for the now 6 months plus old baby

The Australian mother would like to get her child back, fearing her husband might not continue with his Australian treatment and file for divorce and returns back to his homeland.

Q1] New Police powers confronting Domestic Violence , Tell us more ?

The changes are in relation to police power when it comes to domestic violence especially when children are involved.

Now the police has power to take a perpetrator away by force and put restraining orders temporarily without a court order.

Domestic Violence : by definition, physical and mental nature?, because the neighbour next door may complain to the police about the verbal violence that's going on next door, will this raise a restraining order ?, after all it's in the interest of the kids to be removed from these abusive environment !!.

Q2] A listener, is keen to know what changes if any have gone into helping divorced parents living Far, hours drive from each other, help the parent with access to children more easily, The listener, is asking, if there was an order, limiting one parent from moving too far away [ another state, country ], making access to children difficult,

Is it possible to make divorced parents with children living away hours away by car, is obliged to drive the children to a half way, giving access to children daily ?

In relation to divorced or separated parents, since 2012 , the givea priority to the interest of the child " the child best interest is paramount"

So the court may appoint a lawyer to defend the child's interest in all circumstances.

To apply this to your examples, the court may look at if travelling long distance would be contrary or may affect the child health and wellbeing. If so the court will order one of the parents to travel all the way to the other party. Parents interest is becoming more irrelevant.

Q3] Let’s talk about how assets and property get divided after and before separation. It is not 50% to 50% in most cases.

Ohhh yess, no one ever believed it's 50/50 when it comes to Financial settlement, what hurts, the value of your super, it's included in your divorce settlement, but unfairly redeemed by other party [ THE X ].

If a temporary migrant has a baby with an Australian, the baby is a citizen.

But what happens if

the couple splits up and the foreign parent has to leave the country?

1] 1949 - Mrs O’Keefe and the battle for White Australia

Labor Prime Minister Ben Chifley [ 1945 - 1949 ]

Minister for Immigration Arthur Calwell [ 1945 – 1949 ]

In 1942, Indonesian Annie Maas Jacob, her husband Samuel and their children escaped to Australia as the Japanese military advanced into the Dutch-controlled Aru Islands in the eastern archipelago. The family settled in Melbourne and Samuel began work for the Netherlands Indies Forces Intelligence Service, a Dutch intelligence service set up in Australia to monitor the situation in the Dutch East Indies. In September 1944, he was killed in an air crash when returning to Australia from New Guinea, leaving Annie and the children to an uncertain future. The Dutch Government granted Annie a pension of £28 a month. Help also came from their landlord, a retired postal clerk named John (Jack) O’Keefe. With the end of the war, Immigration Minister Arthur Calwell made plans to repatriate the thousands of Asian evacuees who, like the Jacob family, had sought refuge in Australia.

2] 1965 - five-year-old Nancy Prasad [ Indian Fijian ] was deported from Australia.

Aboriginal leader Charles Perkins staged a kidnap to draw attention to the injustice of Australia’s immigration policies.

But the following day the government made sure she left.

In the 1970s, a new Immigration Minister, Al Grassby, responded to a call on live television and teenager Nancy was finally allowed to return to Australia.
