MINUTES OF A SPECIAL MEETING OF
BOARD OF DIRECTORS OF THE BROOKRIDGE HOA, INC.
Call to order at 8:15 PM.
An special meeting of the Board of Directors of Brookridge Homeowners Association, Inc. (“HOA”) was held on June 5, 2018 at the home of Paul Spindel (Unit 1). Present at the meeting were: Carole Princer Levy, Paul Spindel, Monica Teuscher, Barbara Schiff and Jeff Adler - all of whom are Directors constituting a quorum. Also present was Leslie Molinoff from the Condo Conversion sub-committee &
Ralph Elefante, Esq. (representing the HOA in Condo conversion).
Carole Princer Levy acted as Chair of the meeting. Jeff Adler acted as Secretary.
Condominium Conversion report:
Mr. Elefante reports that:
(A). Mr. Ralph Elefante (Brookridge HOA’s Attorney for this conversion) reports that the NYS Attorney General’s office Assistant AG Constance Lisperitis) has not, as of June 5th, given our condominium conversion a “No Action” Letter. New Rochelle requires this letter before they will consider us a Condominium.
(B). Because of the lack of the “No Action” letter the New Rochelle Tax Assessor (Dan Whittimore) is keeping our tax assessment for 2018 at the same "homeowner" rate as 2017. Mr. Whittimore has told Mr. Elefante that to change this assessment for 2018 we will have to “grieve” this assessment
(C). Mr. Elefante feels the “No Action’ letter will be released by the Assistant AG after June 21st. This will be the last step in legally converting our HOA to Condominium. However, if we don’t grieve our 2018 taxes by June 19th we give up the right to protest our 2018 taxes and will have to wait 'till 2019 to reap the benefits of the conversion to a condominium.
(D) Mr. Elefante will be available at the Annual Meeting Tuesday June 12th to discuss this with homeowners.
(E). Plan:
(1). Mr. Elefante may need to give the AG’s office an offering plan before a “No Action” letter is released.
(2). If we plan on grieving our 2018 taxes the Board will need to hire a Tax Appeal Attorney (possibly Bill Sulzer, Esq.). He will “grieve in block” to Westchester County Supreme Court. His fee is based on a percent of savings he attains. (Savings will be paid out from NR to Bill Sulzer, and held in escrow. It will be part of his job to administer and distribute these funds. His fee will also be paid from the escrow fund.)
Leslie & Mr. Elefante leave at 9:30 PM.
The Board discussed this issue and voted, in a split decision, to recommend to the Homeowners, hiring a Tax Appeal attorney to grieve our 2018 taxes.
The Board also discussed:
(1). The request for a basketball hoop to be placed on the tennis court. This proposal will be discussed at the annual meeting. However, there have been many objections raised to this proposal
(2). The Board continues to pursue the replacement of the pad at the front gate. The contract was awarded to Eastco who went out of business. The company that took over Eastco will honor the contract previously signed
(3). Lack of supervision of children at the pool. Parents are reminded that the behavior of your children and their safety is your responsibility. There is no Lifeguard at the pool. Please keep this in mind and supervise your children.
The annual community meeting will be held June 12th at Westchester Jewish Community Center 7:30 PM. Unit owners are urged to attend. In addition to the election of Board members and an open discussion of community issues there will be an update by Ralph Elefante on our conversion to a Condo.
There being no further business before the Board, upon motion made and duly seconded the meeting was adjourned at 9:55 PM.
