This section outlines staff responsibilities for reporting student-related incidents of Harassment, Intimidation, and Bullying (HIB). New Jersey’s Anti-Bullying Bill of Rights Act (ABR) requires all school employees to take immediate action if they witness or receive information that a student may be the target of HIB.
IMPORTANT: If the act appears related to any distinguishing characteristic, it must be reported.
HIB is any gesture, act, or electronic communication that is:
Motivated by an actual or perceived distinguishing characteristic of a student (e.g., race, gender, religion, disability, sexual orientation, or other trait);
Occurs on school property, a school bus, at a school-sponsored event, or off school grounds with a connection to the school environment; and
Results in substantial disruption or interference with the school or another student’s rights, including harm, fear, insult/demeaning, or hostile environment.
Protected classes such as: race, color, religion, ancestry, national origin, gender, sexual orientation, gender identity or expression, and disability (mental, physical, or sensory).
Other traits or characteristics that make a student stand out or different, such as appearance, weight, socioeconomic status, family structure, clothing style or personal expression, perceived intelligence, or other personal attributes.
Not all conflicts, arguments, or mean behavior qualify as HIB. However, all suspected student-related incidents involving distinguishing characteristics must still be reported.
Verbal Report: Inform the principal on the same day you witness or learn of a possible student-related incident.
Written Report: Complete the HIB 338 electronic form as soon as possible.

Confidentiality: Do not discuss incidents with students or parents. Communication with families is handled by the principal/ABS.
The principal reviews the report to determine if it meets the threshold for an HIB investigation.
If so, the investigation begins immediately, led by the Anti-Bullying Specialist (ABS).
Investigations must be completed within 10 school days of the written report.
Reminder: Staff must report immediately if the behavior may be connected to a distinguishing characteristic. The Anti-Bullying Specialist (ABS) and administration will investigate and make determinations.
