Michigan Concussion Law Overview
(Effective June 30, 2013)
PA 342 and PA 343 of 2012 apply to school athletic activities, which include organized practices or competitions, and also physical education classes that are part of the curriculum.
Before a student athlete may participate in an athletic activity sponsored or operated by a school, the school must:
Ensure coaches, employees, volunteers, and other adults, who are involved with the participation of athletes in the athletic activities, participate in a concussion awareness training program through the Michigan Department of Community Health (www.michigan.gov/mdch);
Nature and risk of concussions.
The criteria for the removal of an athlete from participation in an athletic activity due to a suspected concussion and his/her return to that athletic activity.
The risks to an athlete of not reporting a suspected concussion and continuing to physically participate in the athletic activity.
Provide Educational materials on concussion awareness and the nature and risks of concussions to each student athlete participating in the district’s athletic activities and his/her parent or guardian;
Obtain a statement signed by each youth athlete and their parent/guardian acknowledging receipt of the educational materials and maintain the signed form in a permanent file.
A coach or other adult employed by, or volunteering for, or otherwise acting on behalf of the school district during an athletic activity, shall immediately remove from physical participation any student athlete who is suspected of sustaining a concussion during the activity.
The student athlete shall not return to physical activity until he/she has been evaluated by an appropriate health profession and receives written clearance from the health professional authorizing the student athletes return to physical participation. School districts will have to closely scrutinize any written medical slips submitted to ensure that they have been written by an appropriate health professional and clearly state that the athlete is cleared to return to physical activity.
