Harming, shooting down, or disabling a drone is a federal crime under 18 U.S.C. § 32, as the FAA classifies unmanned aircraft systems (UAS) as "aircraft". Damaging a drone can result in up to 20 years in federal prison, fines, and civil liabilities, as it is considered aircraft sabotage. 

Key Federal Legal Points:

• Felony Action: Intentionally damaging or destroying a drone is a federal felony.

• Aircraft Status: Drones are legally protected under the same statutes as passenger planes, regardless of size, under 18 U.S.C.A. § 32.

• Penalties: Penalties can include up to 20 years in federal prison and, in some scenarios, fines up to $250,000.

• No Property Right to Shoot: Landowners do not have the right to shoot down a drone simply because it is flying over their property, as the FAA regulates the airspace above 500 feet, and even low-flying drones are protected. 

What You Can Do (Instead of Harming):

• Report to Law Enforcement: If a drone is causing a nuisance, flying dangerously, or spying, call local police.

• Identify the Drone: Check for the required Remote ID and report the operator to the FAA.

• Civil Action: You may be able to sue the operator for invasion of privacy or trespass, but you cannot legally destroy the property. 

Safety Risks:

Attempting to harm a drone can lead to a lawsuit from the operator and charges for shooting a firearm in a prohibited area. An injured drone can become uncontrollable, posing a danger to people and property on the ground.
