There’s a lot to keep track of when you’re on sick leave and we want to make sure you feel supported through the whole period, and that you are aware of both your rights and your responsibilities. Below is a brief overview of your rights and responsibilities when you are on sick leave.
Reporting and documenting absence
You are responsible for letting your manager know that you are on sick leave and for submitting your medical certificate to both your manager and through your NAV portal.
Attending follow-up meetings
You are required to attend follow-up meetings, if relevant, with your manager, NAV, or other relevant parties. The purpose of these meetings is to help identify suitable workplace adjustments and help you return to work in the best way.
Cooperating on workplace adjustments
If possible in your situation, you are expected to take an active role in discussions about adapting your work situation. This may include talking about options for graded sick leave (less than 100%) or other arrangements that can make your return to work easier. If workplace adjustments and/or graded sick leave allows you to return to work prior to your sick leave ending, you are required to do so.
Informing about changes
If there are changes in your health condition or if you receive new treatment that will change your follow-up needs or adjustment needs, you should inform your manager and NAV so that the follow-up process can be adapted to your situation. Keep in mind that you do not have to share any personal details about your health situation or condition if you do not want to. If your health condition improves enough to return to work in full capacity before your sick leave ends, you are required to do so and should inform your manager and NAV about this as soon as possible.
Right to sickness benefits
If you are entitled to sickness benefits, Oda will pay your salary or sickness benefits during the first 16 days (the employer period). After that, NAV takes over the payments. These benefits are meant to secure your income during your period of sick leave.
Right to work adjustments and graded sick leave
You have the right to have your work tasks or hours adjusted, if possible, to support a gradual return to work. This may include graded sick leave, where you for example work part-time while recovering.
Right to follow-up and support
Both NAV and Oda are obligated to provide follow-up and support. This includes a safe and well-organized return to work through necessary adjustments and workplace assistance.
Right to participation
You have the right to be heard and to take part in planning your return to work. It’s important that your needs and preferences are taken into account in discussions with both your manager and NAV.
Privacy and confidentiality
Information about your health condition must be treated confidentially. You have the right to ensure that personal data related to your sick leave is not shared without your consent, unless it is necessary for the follow-up process.
You can read more about your rights and responsibilties at NAV's website: https://www.nav.no/sykmeldt.
Expert assistance is a support tool from NAV. It involves an independent expert (arranged through an external health and work-related company e.g Fønix) who looks at your ability to work and what changes or support might help you return to work, either full-time or part- time.
The expert is neutral and does not replace your doctor. Their job is to give advice about what might help you manage work tasks and health in the best possible way.
The goal is to find practical solutions together so you can return to you work.
Oda uses expert assistance actively if you have been on sick leave for a while or where we need extra support to move forward. It helps both the employee and the employer to understand what is needed and your participation in the process is very important.
When you are on sick leave, you must cooperate with your employer to find ways back to work. If you don’t want expert assistance, you must have another medical or treatment plan that supports your return to work, for example:
Specialist care
Ongoing medical assessment
A work-related measure planned with NAV.
❗️Saying no to expert assistance without a good reason may be seen as not cooperating which in some cases, could affect your sick pay or lead to a formal warning.
