Individual Work Contract for an indefinite period of time, submitted by THE AMERICAN SCHOOL FOUNDATION OF GUADALAJARA, A.C. represented by DAVID C. McGRATH, Director General of the school, and Name.
After agreeing to the above statements both parties agree to fulfill and observe the following:
C L A U S E S
FIRST. From here on forth we will name THE AMERICAN SCHOOL FOUNDATION OF GUADALAJARA, A. C. “THE SCHOOL”; Name ”THE TEACHER”; Mexican Labor Law “THE LAW”; this document “THE CONTRACT”; and the undersigned “THE PARTIES”.
SECOND. THE TEACHER agrees to render his/her subordinated and personal services to THE SCHOOL in the position of __, and carry out his/her corresponding duties.
THIRD. THE TEACHER agrees to render the aforementioned services at the school’s address, and, from this date on, accepts to render his/her services at any other address that THE SCHOOL deems necessary according to its needs, for administrative reasons, development, or any other cause that may arise.
FOURTH. THE TEACHER will earn for his/her services a basic monthly salary for the amount of $__; a monthly compensation in U.S. Dollars for his/her U.S. Type quality of $__.
FIFTH. THE PARTIES agree that the TEACHER’S starting date was __.
SIXTH. THE TEACHER will be granted vacation days as established by THE LAW, and proportional to the time he/she has worked for THE SCHOOL. A vacation bonus will be paid equivalent to 25% of the vacation days granted by THE LAW, and increased by two days. In addition he/she will receive for a full year of service a Christmas Bonus equivalent to the monthly base salary plus the amount given for Food Coupons, Attendance Bonus, and Savings Fund, or proportional to the time of service given in terms of paragraph II, article 87 of THE LAW.
SEVENTH. THE TEACHER agrees to undergo any medical exams that THE SCHOOL deems necessary to ensure the optimal, physical, and intellectual condition of THE TEACHER that will guarantee the adequate performance of his/her duties, as established in fraction X, of article 134 of THE LAW.
EIGHTH. THE TEACHER is obligated to attend staff development training provided by THE SCHOOL and to observe the security measures implemented by the respective law, and THE SCHOOL.
NINTH. THE TEACHER agrees to work 48 hours a week, as established by Mexican law, within the working hours established by THE SCHOOL, that are from 7:45 a.m. to 5:20 p.m., and that could vary according to THE SCHOOL’S needs, and in agreement with articles 59, 60 and 61 of THE LAW. THE TEACHER should sign in on the corresponding attendance sheet. In case of tardiness or non-justified absences THE SCHOOL may take the necessary steps to correct the fault in accordance with the general working conditions and THE LAW.
TENTH. THE TEACHER agrees that the address mentioned in statement number two of this contract will be effective for any notification that THE SCHOOL should send to THE TEACHER. In case of a change in address THE TEACHER will be responsible for notifying THE SCHOOL.
ELEVENTH. The parties agree that this contract is effective ____.
TWELFTH. All those items not specified in this contract because of its briefness, will be subject to the General Working Conditions and THE LAW.
