PRE-EMPTION
Narrated by Jabir bin Abdullah
The Prophet (Peace & Blessings of Allah upon Him) has decreed that Pre-emption is Valid in all cases where the Real Estate concerned has not been divided, but if the boundaries are established and the ways are made, then there is no Pre-emption.
Note: Pre-emption - The purchase of goods or shares by one partner or party before the opportunity is offered to others (outsiders).
The foundation of the Right of pre-emption (to the partner) is the human desire to avoid the inconvenience and disturbance which is likely to be caused by the introduction of a stranger into the land.
