HADITH OF THE DAY
HAND CUT OFF (FOR STEALING)
Narrated by Aisha
The Prophet (Peace & Blessings of Allah upon Him) said, "The hand should be cut off for stealing something that is worth a Quarter of a Dinar or More."
Note:
- Islamic Law do not cut the hand due to Simple Theft, and it is done by the Judge in the Tribunal of an Islamic Country.
- The Stolen item should be More than 4.374 grams of Gold, also the person stealing is Not Hungry, but wants corruption in the land, and this must be a lesson for people to stop theft in order to enrich.
- Thus cutting off the hand is to stop the Mafia and Spoilers and not for the poor.
- The Second Caliph Umar bin Khattab Suspended the Sharia Punishment for Theft during Famine
Conditions for the Penalty of Theft:
1) The one who steals is Sane
2) The one who steals has reached Puberty
3) The one who steals Steals (from a secure place) equivalent to 4.374 grams of Gold or more
4) The Theft has to be Proven, either by the testimony of 2 qualified witnesses or by the confession of the thief twice
5) The Person from whom the property was stolen has to ask for it back
The Penalty:
The penalty for the one who steals (when the above conditions are met) is that his/her Right hand is Amputated. If a person steals a Second time, his Left foot is Amputated; if a Third time, then he will be imprisoned until he repents, but no further amputation will take place.
