A consensual romantic or sexual relationship between any staff and student, is expressly prohibited where the staff or employee has power or authority over the student.
This policy also applies to students engaged in the employment of services to Capital.
Any form of sexual behavior with or towards a student is both inappropriate and can be illegal.
Statutory laws prohibit any form of sexual contact with students under the age of 16, even if it is consensual.
Penal Code Section 376A
In the context of our policy, sexual behavior is not limited to physical acts, whether penetrative or non-penetrative. It also encompasses non-physical activities, such as inducing or causing students to participate in or observe sexual activities or the creation of explicit material.
It's important to note that sexual activity can often be preceded by a process known as "grooming." This is a deliberate strategy employed by an adult to establish trust with a younger individual, with the sole intention of manipulating that relationship to facilitate sexual abuse.
Showing undue attention or favoritism towards a student could be perceived as part of the "grooming" process. Please be aware that "grooming" is a punishable offense under the law.
