General Stopping Authority
The Ontario Highway Traffic Act section 216(1) states that: A Police officer, in the lawful execution of his or her duties and responsibilities, may require the driver of a vehicle to stop and the driver of a vehicle when signalled or requested to stop by a Police officer who is readily identifiable as such, shall immediately come to a safe stop” Failure to stop for Police is arrestable without warrant and subject to No Set Fine, a minimum fine of $1000 and a maximum fine of $10,000 and potential 6 months in jail.
Inspection Authority
The Ontario Highway Traffic Act section 82(2) specifically states: “Every Police officer and every officer appointed for the purpose of carrying out the provisions of this Act may require the driver of any vehicle to stop, move the vehicle to a safe location as directed by the officer and submit the vehicle, together with its equipment to the examination and test that the officer may consider expedient”. Offences when not compliant.
