How to Complete a Conditional Sentence Order (CSO) Package
A Conditional Sentence Order allows an Accused to serve their sentence in the community. When there is an Allegation of Breach, the Accused person must be brought before a Justice within 24 hours to determine whether the CSO will be cancelled and the Accused taken back into custody.
Steps to Complete a CSO Breach:
1. Send a CPIC message to Corrections to order a copy of the Conditional Sentence Order.
2. Call the probation officer and ask them to complete the Supervisor's Report of an Allegation of Breach and send it to Courts. If it is after business hours, leave a message for the Probation Officer and/or send an email. Document this information in your general report. The Probation Officer’s name and contact info can be found on the first page of the fax received by Corrections when the copy of the CSO is ordered.
The following forms are found under the Accused, in the reports tab, under CSO forms:
Complete the Conditional Sentence Order Notice of Intention to Produce a Supervisor's Report on an Allegation of Breach. Fill in the Probation Officer's name, the date and the names and badge numbers of the involved officers/witnesses. Print and sign.
3. Complete the Conditional Sentence Order Allegation of Breach form. Print and sign.
4. Fill out the Conditional Sentence Order Affidavit of Proof of Service form. Print and sign where it says “Peace Officer” and swear to it at records,
The following form should be created under the Witness or Officer
5. Complete the Conditional Sentence Order Statement of a Witness on an Allegation of Breach form. This is where you type/copy your will say. If there is more than one witness officer involved, each officer will have a form. Print and sign. (NOTE: if Police did not find the accused breaching, a statement from a civilian witness must be completed on the CSO Statement of Witness form)
6. Once you have completed and signed all 4 forms, you must BDL them back into the occurrence.
7. Serve a copy of each of the documents on the Accused.
8. The original signed hard copies of each form needs to go Court and must be there for the Accused bail hearing. Depending on the circumstances (if bail court has already started, accused will appear in afternoon court, WASH Court) the completed forms can go to the records back counter to be taken over to courts or the completed forms will need to be taken to the courthouse by the officer.
