Definitions:
Child (child protection) – under 16 yrs (not including 16 )
Place of Safety – foster home, hospital
CHARGES: proceed by Part III
Authority:
Child Protection Worker (includes Police)
Authorized to:
1. Enter with Warrant:
a. Anytime
b. Any premise specified in warrant or order
c. Search and/or remove child
2. Enter without Warrant:
a. Reasonable grounds to believe a child is need of protection AND there is a risk to the child’s health and safety
b. Exigent circumstances – no time to wait to get a warrant
Duty to Report:
RPG to suspect (suspicion counts), the following persons shall report forthwith:
a. Healthcare Professional (doctor, nurse, dentist, pharmacist, psychologist)
b. Educator (teacher, principal, social worker, youth recreation worker, nursery worker, ECE)
c. Religious Leader (Priest, Pastor, Imam, Rabbi)
d. Police
e. Coroner
f. Solicitor (lawyer)
g. Youth Service Provider
Curfew: Midnight to 6:00am (for a child - someone who is actually or apparently under the age of 16)
Apprehension of a child by Police Officer without Warrant:
1. Found between midnight and 6:00am in a public place or place of public entertainment (unless parent accompanies the child or authorizes a specific individual 18yrs of age or older to accompany the child)
2. In need of protection
3. Commits any offence
4. Absent from a facility without leave (example – group home)
5. When called upon to assist child protection worker
