Summary Offences are "Find Committing" offences for Arrest
Find Committing:
a) seeing the person actually committing an offence (caught in the act)
b) seeing the person actually committing an offence and pursuing that person immediately and continuously until that person is arrested

You can still charge a person for a Summary offence if they were not "found committing". Confirm identity and request a criminal summons
