SMM Decal (SMM SOT DECAL) C.R.S. 4

Requirements: Issued to all SMM that are on tracks (not rubber tires). This decal category is issued to equipment that will be hauled on the back of a truck or trailer to the destination such as welders, generators, loaders, backhoes, excavators, dozers, etc., mobile office trailers that are used as a temporary office location will receive the SMM Decal.

Info: A Letter of Authorization or a Corporate Resolution to Borrow/ Grant Collateral Letter granting permission for the agent to act on behalf of the company and the agent’s secure and verifiable identification information are required for all companies to purchase SMM decals. SMM Rental Decal C.R.S. 42-3-107(16)

Requirements: SMM that is driven, hauled or pulled over public highways to reach their destination. May include truck cranes, wheel loaders, motor scrapers, truck scrapers, truck mounted tree spades, backhoe, sweepers, asphalt and/or tar kettles, portable concrete mixers, portable air compressors, etc. The decals are issued to all businesses that qualify for the alternate method of paying ownership tax, 2% SMM rental program. SMM participating in the SMM Rental program is required to be registered with a SMM License Plate or SMM Ownership Decal. Both the SMM registrations and SMM Rental shall expire concurrently. C.R.S. 42-3-107(16)(b).

Note: An SMM exempt plate may also be attached to the vehicle (see Exempt Plate this section).
SMM 2% Rental Program Information
The SMM 2% Rental Program is an alternative payment program allowing Colorado SMM companies who Rent or Lease SMM, for at least 30 days in a calendar year, to pay the Specific Ownership Tax on 2% of the Rental or Lease amount rather than paying the Specific Ownership Tax for a full year.
SMM 2% Rental Fleets that regularly have more than 10 pieces of SMM in the state, to register SMM with permanent decals or Fleet license plates without validation tabs.
Definition
Rental: A period of at least 30 days in a calendar year in which the owner of SMM rents that SMM to another entity for payment.
Lease: A period of more than 30 consecutive days in which the owner of SMM leases that SMM to another entity for payment.
To Participate in the SMM 2% Rental Program:
SMM must first be registered with the SMM license plate or SMM Ownership Decal.
The SMM Company must submit a completed DR 0440 – Permit to Collect Sales Tax on a Rental or Lease Basis to the Department of Revenue Sales Tax Division for approval.
The SMM Company must complete the DR 2091 – SMM 2% Ownership Tax Authorization Request and submit it along with the Approved DR 0440 form to the county in which the Equipment Company is located. The county will either Approve or Reject the application.
The DR 2091 - SMM 2% Ownership Tax Authorization Request must be remitted every year to the county office for approval.
If the County rejects the SMM Company application, they cannot participate in the SMM 2% Rental Program.
Once the application is approved, the SMM Company will furnish the county with a list of all their equipment. The County will assign an SMM 2% Rental Decal to each piece of equipment. These decals must be affixed to the outside of the SMM, visible to law enforcement.
The decals are renewed every year and no renewal notice is provided. The SMM Company must provide the county with a complete list of all equipment each year.
A DR 2671 SMM Rental Equipment Monthly Tab Report must be completed and sent by the 20th of each month to the following:
The county that issued the SMM 2% Rental Decals
Each county where the SMM was used
This report should reflect the SMM status as: Rented, Not Rented, or Sold for every SMM that has been issued a SMM 2% Rental Decal.
Applicable 2% Rental fees are remitted along with the DR 2671 SMM Rental Equipment Monthly Tab Report to each county in which the equipment was used. Any form used other than the official DR 2671 must be approved by the Department of Revenue – Registration Section.
SMM 2% Rental Fleet
SMM owner participating in the SMM 2% Rental program that regularly has more than 10 pieces of SMM in the state to register owned SMM in a SMM 2% Rental Fleet.
SMM owner shall apply to the Title and Registration Sections using the DR 2428.
Upon approval, the SMM will be registered in the SMM 2% Rental Fleet.
SMM registered in an SMM 2% Rental Fleet will be issued:
On Highway SMM
Permanent SMM rental decal, and
Fleet license plate without validation tabs
Off Highway SMM
Permanent SMM rental decal, and
Permanent SMM specific ownership tax decal
Similar to permanent fleet, SMM 2% Rental Fleets are not required to replace their decals or be issued year and month tabs annually.
Please note that the SMM rental and specific ownership tax decals have been modified to include an area marked “PERM”. Upon issuance of the decals to SMM rental fleets the word “PERM” should be hole punched in lieu of an expire month and year.
Sold 2% Rental SMM
SMM reported as sold on the DR 2671 SMM Rental Equipment Monthly Tab Report should be checked in the Reg/Title program to verify that the new owner has registered the SMM in their name. If the new owner has registered the SMM, then no further action is necessary. If the new owner has not registered the SMM in their name, the county should send the new owner a letter notifying them of the registration requirements.
C.R.S. 42-3-107 (16)(b) states “The owner shall be required to remove any identifying decal upon the sale or change of ownership of such item of SMM.”
SMM Exempt Plate C.R.S. 42-4-202(4)

Requirements: SMM that is registered with an SMM plate or decal, but does not conform to Colorado lighting requirements, must also display an SMM Exempt plate. This plate exempts the unit from certain physical requirements only. Taxes are still assessed.

Requirements: The SMM Dealer Demo license plate may be displayed on special mobile machinery for sale and being demonstrated for the purpose of a sale. The SMM Dealer Demo license plate is issued to a person who sells special mobile machinery in the ordinary course of business. Person requesting to be issued the SMM Dealer Demo license plate shall provide sufficient evidence that they sell special mobile machinery in the ordinary course of business.

Suspected Fraudulent Documents
Fraudulent Document(s): A fraudulent document is any document such as a Title, Registration, Insurance Card etc,. that was presented by a customer that is a false representation of the original, it appears to be counterfeit, altered, or non-genuine) (otherwise fake).
Types of Suspected Fraud
POA/Notary: If a customer has presented a power of attorney that appears to have an incorrect notary seal, or the customer frequently uses the same POA and Notary under what appears to be suspicious activity.
Dealer Licensing Fraud: If you suspect a customer is unlawfully selling vehicles as a non- licensed dealer.
Fraudulent DL/ID: If you suspect a customer has shown SVID such as a driver license or identification card that appears to be counterfeit or altered, follow the fraud procedures.
Suspicious Incident/Person: If you suspect a person is attempting to defraud the DMV in any manner report suspicious activity to the Department.
Other: This section is for any other type of referral you deem pertinent for the department.
Suspected Fraud Reporting Process
If an application is suspected to be fraudulent but there is not enough information to deny the application, form DR2407 will need to be completed. Form DR2407 must be scanned with all other title documentation. Once you have created the record, you can select Request for Investigation from the Vehicle titling case.
Special Mobile Machinery (SMM) 2% Registration Exempt Program
The Special Mobile Machinery (SMM) 2% Registration Exempt Program allows companies with 250 pieces or more of SMM to apply for registration exemption. This exemption will stop the requirement that a company put plates and/or decals on all owned pieces of equipment if they meet the qualifications and pay for associated plates/decals.
This program is administered by State Program Personnel in accordance with C.R.S. 42-3-107 and C.C.R. 204-10.
Qualifications to enter the program:
The owner regularly has 250+ SMM items in Colorado
Equipment requirements:
Each SMM is clearly marked with the following information:
Owner's name
Unit number
Toll-free telephone number to be used for verification purposes
SMM that require a title will continue to be titled by the county.
Existing decals and plates will need to be removed from all SMM participating in the Registration Exempt program.
Audits and compliance:
The State Program Personnel can require the following to ensure compliance with the program:
Images of equipment and markings
Weight Slips to verify details on reported equipment
Rental receipts to verify details on reported equipment
In-person site visits to help SMM owners comply with requirements of the program.
2% Fleet Accounts:
2% Fleet accounts will need to be maintained by the SMM owner. The program will not automatically delete or cease any SMM from existing accounts in the DMV’s system. SMM owners are responsible to ensure that no credit is used as a result of entering the program, and no renewals are accidentally processed (there will be no refund if an SMM owner chooses or accidentally registers SMM after it is entered into the program).

Payments and submission of forms, after acceptance to the program, is done via the online portal.
Participants pay road safety, bridge safety and the registration base fee upon initial entry to the program and at the time of renewal via the online portal. Participants will report newly added and sold equipment annually at the time of renewal using the DR2851.
Participants will submit the DR2671 by the 20th of each month, reporting the 2% SOT amount due per county in addition to documenting attestation of sales tax. The DR2671 utilized by program participants is accessed via the portal account and differs from the DR2671 used by counties.
Counties will continue to receive the 2% SOT on a monthly basis in one payment rather than separate checks or payments from the company. Monthly breakdowns by company and county, in addition to other county bookkeeping job aides can be found on the DRIVES Intranet.
