A

Abandoned Private

Any motor vehicle left unattended on private property for a period of twenty-four hours or longer or for such other period as may be established by local ordinance without the consent of the owner or lessee of such property or the owner’s or lessee’s legally authorized agent; (b) Any motor vehicle stored in an impound lot at the request of its owner or the owner’s agent and not removed from the impound lot according to the agreement with the owner or agent;(c) Any motor vehicle that is left on private property without the property owner’s consent, towed at the request of the property owner, and not removed from the impound lot by the vehicle owner within forty-eight hours; or (d) A motor vehicle fitted with an immobilization device that is on private property and deemed to be abandoned pursuant to section 42-4-1105 (7) (c). C.R.S. 42-4-2102 (a)

Abandoned Public

Any motor vehicle left unattended on public property, including any portion of a highway right-of-way, outside the limits of any incorporated town or city for a period of forty-eight hours or longer;(b) Any motor vehicle left unattended on public property, including any portion of a highway right-of-way, within the limits of any incorporated town or city for a period longer than any limit prescribed by any local ordinance concerning the abandonment of motor vehicles or, if there is no such ordinance, for a period of forty-eight hours or longer;(c) Any motor vehicle stored in an impound lot at the request of a law enforcement agency and not removed from the impound lot within seventy-two hours after the time the law enforcement agency notifies the owner or agent that the vehicle is available for release upon payment of any applicable charges or fees;(d) A motor vehicle fitted with an immobilization device that is on public property and deemed to be abandoned pursuant to section 42-4-1105 (7). C.R.S. 42-4-1802 (a)

Abandoned Repair Shop

A motor vehicle (A) That has been left at a repair shop by the motor vehicle’s owner, the owner’s agent, or an operator hired by the owner or owner’s agent; (B) That the repair shop has offered to repair and for which the repair shop has prepared an estimate of costs; (C) That the owner or the owner’s agent has refused to authorize repairs to, has refused to remove from the repair shop upon request, or has refused to pay for authorized and completed repairs to the vehicle. If the repair shop is unable, despite good faith efforts, to obtain a response from the owner or the owner’s agent regarding the authorization of repairs, payment for authorized and completed repairs, or the removal of a motor vehicle, the owner or owner’s agent shall be deemed to have refused to grant authorization, make payment, or remove the motor vehicle five working days following the repair shop’s last good faith effort to contact the owner or owner’s agent. (D) That is not the subject of sale negotiations or a sale agreement between the owner or the owner’s agent and the repair shop. C.R.S. 38-20-116 (2.5)

Affidavit

A formal sworn statement, signed by an affiant or deponent and witnessed by a taker of oaths, such as a notary public. Affidavit of Collection of Personal Property Pursuant to a Small Estate: Affidavit used for deceased estate, sixty thousand dollars and less, to show a successor when there is no probate, pursuant to C.R.S. 15-12-1201.

Agent

A person who is authorized by the principal or by operation of law to make contracts with third persons.

Amount of Lien

Should be equal to the amount of the loan secured by the mortgage.

Appoint

To select a person or a group of people for an official position or to do a job.

Appraisal

A bona fide estimate of reasonable market value made by any motor vehicle dealer licensed in this state.

Assigned VIN for Motorized Vehicle

A special VIN tag issued by the State which begins with ID and ends in COLO. This ID is affixed on the vehicle by the Colorado State Patrol. Example: ID12345COLO

Assigned VIN for Trailers and Manufactured Homes

A special VIN tag issued by the County Motor Vehicle office for homemade trailers, or manufactured homes and trailers with obliterated or missing identification numbers. Example IDTL123456CO, or ID_______CO. Begins with ID and ends with two alpha characters.

Assignment

A transfer to another party of any property, real or personal. For proper assignment of titles, see C.R.S. 42-6-110.

Authorized Agents

County clerk and recorders in each of the counties of the state, including the city and county of Broomfield, and the manager of revenue or such other official of the city and county of Denver as may be appointed by the mayor to perform functions related to the registration of motor vehicles. C.R.S. 42-6-102(1)

B

Bankruptcy

 A legally declared inability or impairment of ability of an individual or organization to pay their creditors.

Bicycle

Means a vehicle propelled by human power applied to pedals upon which a person may ride having two tandem wheels or two parallel wheels and one forward wheel, all of which are more than fourteen inches in diameter. C.R.S. 42-1-102 (10)

Bill of Sale

A document signed by the seller attesting to the sale of the personal property described therein to the buyer. A bill of sale for a motor vehicle must contain a complete description of the vehicle – VIN, Year, and Make – the total sale price, the buyer’s name and the seller’s signature. The bill of sale must contain a perjury statement or be notarized.

Bill of Lading

A document issued by a carrier reciting the receipt of goods and the terms of the contract of transportation. Regulated by the Federal Bills of Lading Act or the Uniform Commercial Code.

Body Style

The vehicle body style as designated by the manufacturer and describes the appearance of the vehicle.

Bona fide

A term used in the law of real property and personal property to refer to an innocent party who purchases property without notice of any other party’s claim to the title of that property.

Bonded Title Vehicle

A vehicle the owner of which has posted a bond for title pursuant to the provisions of section 42-6-115. C.R.S. 42-5-201(1)

C

C-Corporations/C-Corps

C-Corporations also referred to as Standard or General Corporations are a separate tax paying entity for federal and state tax purposes. The ‘C’ in C-Corporation refers to Subchapter ‘C’ in the tax code. The C-Corporation is legally considered to be a unique business structure separate from its owners. This limits the personal liability of the owners or investors to the amount of their original investment. The owners of a C-Corporation are called shareholders. They elect a board of directors to oversee the major business decisions and policies. The

directors appoint officers to run the day-to-day business operations. President, Vice-President, Secretary and Treasurer are typical officer positions. Secure and verifiable identification is not required.

Calendar Year

January 1st through December 31st of each year.

Camper

An item of equipment, weighing more than 500 pounds, that can be permanently or temporarily mounted onto a motor vehicle; converts the vehicle to temporary living and/or sleeping accommodations. (Not titled or registered)

Camper Trailer

A wheeled vehicle having an overall length of less than twenty-six feet, without motive power, which is designed to be drawn by a motor vehicle over the public highways and which is generally and commonly used for temporary living or sleeping accommodations. C.R.S. 42-1-102(14)

Certified Copy

Attestation of a true copy of the original document.

Certificate of Destruction

If a manufactured home is destroyed, dismantled, or sold or otherwise disposed of as salvage on or after July 1, 2008, the owner of the manufactured home or the person on whose real property the manufactured home is situated shall file a certificate of destruction. C.R.S. 38-29-204(1)(a)

Certified VIN (Vehicle Identification Number) Inspection

Are performed by certified peace officers and include a physical inspection of the vehicle or commercial vehicle and a computer check of the state and national database. If the inspector determines that the vehicle identification number has not been removed, changed, altered or obliterated and that it is not the identification number of a wanted or stolen vehicle or commercial vehicle, the inspection form shall be transmitted department.

Chattel Mortgage

“Mortgage” or “chattel mortgage” means a security agreement as defined in section C.R.S. 4-9-102(76). C.R.S. 42-6-102(9) 

Colorado Assigned VIN (Vehicle Identification Number)

The department of revenue is authorized to assign a special vehicle identification number to any street rod vehicle whenever required by section C.R.S. 42-6-108 and to any vehicle or commercial vehicle whenever no vehicle identification number is found on the vehicle or whenever a vehicle identification number has been removed, changed, altered, or obliterated. Such special number shall be affixed to the vehicle or commercial vehicle in the manner and position determined by the department of revenue. begins with ID and ends in COLO. This ID is affixed on the vehicle by the Colorado State Patrol. Example: ID12345COLO. Such special number shall then be the vehicle identification number required to be recorded by an inspector on the inspection form that is transmitted to the department. The vehicle or commercial vehicle shall then be registered and titled under the special vehicle identification number. C.R.S. 42-5-205

Collector Vehicle

A motor vehicle, including a truck or truck tractor, that is of:

(a) Model year 1975 or earlier; or

(b) Model year 1976 or later that was registered as a collector's item prior to September

1, 2009; except that a vehicle so registered is not eligible for registration as a collector's

item upon sale or transfer to a new owner;

OR

(c) A model year at least thirty-two years old; except that, if the vehicle is being registered in the program area, as defined in section 42-4-304:

(i) The vehicle must have passed an emissions test meeting the standards of part 3 of article 4 of this title within the last twelve months before being initially registered by the owner as a collector's item; and

(ii) The owner must sign an affidavit that the vehicle will not be driven on roadways for more than four thousand five hundred miles per year.

Commercial Vehicle

“Commercial vehicle” means a vehicle used to transport cargo or passengers for profit, hire, or otherwise to further the purposes of a business or commercial enterprise. This does not apply for purposes of section C.R.S. . 42-4-235. C.R.S. 42-1-102(17.5)

Converter Gear

A set of wheels, axle and fifth wheel connection, used to connect a second or third trailer to the first trailer. Not titled or registered in Colorado.

Conforming VIN (Vehicle Identification Number)

Beginning with the 1981 model year, the National Highway Traffic Safety Administration, Department of Transportation, requires manufacturers selling over-the-road vehicles in the United States to produce the vehicles with a 17-character fixed format VIN. This VIN format applies to passenger cars, multipurpose passenger vehicles, trucks, buses, trailers, incomplete vehicles and motorcycles and is for the purpose of identification and inventory control as mandated by the Federal Government.

Copy

A readable photo or scanned copies of an original document.

Court Order

A writ issued by a court of law requiring a person to do something or to refrain from doing something.

Courtesy Delivery

Courtesy Delivery is a service that dealers perform for the delivery of newly manufactured fleet vehicles and vehicles purchased by an individual, directly from an Out of Country manufacturer.

CSTARS

Colorado State Titling and Registration System. (No longer in use)

CWT (Hundred weight) 

A unit of weight in the US Customary System equal to 100 lbs. Empty weight of the vehicle required for titling/registering of the vehicle. Using the empty weight provided, round up to the nearest hundred pounds and drop the last two zeros. Example: Empty weight of the vehicle – 4726 pounds, round weight up to 4800 pounds, drop the last two zeros. CWT= 48

D

Date of Application (Acceptance Date)

The date the title application is processed in the County office.

Date Accepted

The date the title application is processed in the County Office.

Date Filed (Lien File Date)

The date the lien was filed or perfected in the County office.

Date of Purchase

The date the applicant originally purchased the vehicle.

DD214

Certificate of Release or Discharge from Active Duty (refer to Military type plates)

Dealer

Any person, firm, partnership, corporation, or association licensed under the laws of this state to engage in the business of buying, selling, exchanging, or otherwise trading in motor vehicles. C.R.S. 42-6-102(2)

Dealer’s Bill of Sale

The Colorado Dealer Bill of Sale is a secured form used to transfer a roadworthy vehicle from a licensed Colorado automobile dealer to an individual or another dealer.

Death Certificate

A legal document showing proof of a death.

Department

The department of revenue of this state acting directly or through its duly authorized officers and agents. C.R.S. 42-1-102(24)

Destruction

The action of destroying a motor vehicle or manufactured home; to ruin completely, beyond possibility of use.

Disability (or Disabled)

A physical impairment that meets the standards the Code of Regulations, 23 CFR 1235, which impairment is verified, in writing, by a professional. To be valid, the verifying professional shall certify to the department that the person meets the standards on the DR 2219.

Dismantle

To take apart, reduce to pieces.

Divest

To deprive; to take away; to withdraw property. The court orders the offending party to rid itself of property or assets before the party would normally have done so.

Divorce

The legal separation of husband and wife effected for cause by the judgement of a court and either totally dissolving the marriage relation, or suspending its effects so far as concern, the cohabitation of the parties.

Document

An original piece of written or printed matter conveying authoritative information or evidence.

Duration Date (Lien Maturity Date)

The time during which the lien exists and lasts.

E

e-file

An electronically filed legal document.

Emission

A motor vehicle discharge or release of one or more air contaminants into the atmosphere.

Emission Testing

The Automobile Inspection Readjustment Program (AIR) performed on gas and diesel powered vehicles. C.R.S. 42-4-301 thru 42-4-317

Empty Weight

The weight of any motor vehicle or trailer or any combination thereof, including operating body and accessories, as determined by weighting on a scaled.

Encumbrance

A lien or charge against property, as a mortgage.

Entity

A firm, corporation, or person that exists as a distinct unit.

Essential Parts

All integral parts and body parts, the removal, alteration, or substitution of which will tend to conceal the identity or substantially alter the appearance of the vehicle. C.R.S 42-1-102(30)

F

Farm Tractor

Every implement of husbandry designed and used primarily as a farm implement for drawing plows and mowing machines and other implements of husbandry. C.R.S 42-1-102(33)

File No. (Reception No.)

The lien file number assigned in the County Clerk’s office to the chattel mortgage or security agreement.

First Lien of Record Filed to

The name and address of the lienholder as shown on the chattel mortgage or security agreement.

Fleet

A group of 10 or more vehicles titled in the same owner’s name with a common expiration cycle.

Floor Plan

A dealership’s inventory held by a lender.

Foreign Vehicle

Every motor vehicle, trailer, or semitrailer which is brought into this state otherwise than in the ordinary course of business by or through a manufacturer or dealer and which has not been registered in this state. C.R.S. 42-1-102(37)

G

General Partnership

The General Partnership may be considered the baseline for all of the different types of partnerships. All partnerships are formed by an agreement among the partners. In a general partnership, this agreement may be very simple and unwritten or be very complex and governed by lengthy written contracts. Because partnerships are created and governed by contracts, they are very flexible and may be created in such a manner to meet the individual needs of each partner. There are no official filing requirements with the state in order to form a general partnership. Partners in a general partnership may be individuals, corporations, other legal entities (such as trusts) or other partnerships. Management of the partnership is accomplished by the partners and unless the partnership agreement states otherwise, decisions are made by a majority vote of the partners. Unless otherwise provided for in the partnership agreement, general partners share profits and losses equally. Unless operating under the names of the partners, a partnership must file for a trade name with the state. Similar to a sole proprietorship, each partner in a general partnership is personally liable for the partnership liabilities. Liability for general partners is called “Joint and Several”, which means that any one partner can be held responsible for the full amount of the partnership’s liabilities. Additionally, unless otherwise stated in the partnership agreement, a General Partnership is dissolved upon the disassociation (willful withdrawal, death, or filing a voluntary or involuntary petition of bankruptcy) of any partner. Secure and verifiable identification is required for title and registration transactions conducted on a vehicle owned by a general partnership.

Graduated Annual Specific Ownership Tax

An annual tax imposed in lieu of an ad valorem tax upon the personal property required to be classified by the general assembly pursuant to the provisions of section 6 of article X of the state constitution. 42-1-102(40)

Gross Vehicle Weight (GVW)

The empty weight of the vehicle PLUS the maximum weight of the load that can be transported by the vehicle.

Gross Vehicle Weight Rating (GVWR)

The maximum weight the vehicle can transport as determined by the manufacturer.

Guardian

One who has legal authority and duty to care for another's person or property, esp. because of the other's infancy, incapacity, or disability. A guardian may be appointed either for all purposes or specific purposes.

H

Heirs

Those persons legally specified to receive the estate of a decedent.

Homemade Vehicle

A vehicle which is constructed by a manufacturer not licensed by the state of Colorado and which is not recognizable as a commercially manufactured vehicle. The vehicle is built from a variety of parts and does not resemble any commercially manufactured vehicle of a given make, year or type. C.R.S. 42-5-201(4)

I

Implement of Husbandry

Every vehicle that is designed, adapted, or used for agricultural purposes. It also includes equipment used solely for the application of liquid, gaseous, and dry fertilizers. Transportation of fertilizer, in or on the equipment used for its application, shall be deemed a part of application if it is incidental to such application. It also includes hay balers, hay stacking equipment, combines, tillage and harvesting equipment, agricultural commodity handling equipment, and other heavy movable farm equipment primarily used on farms or in a livestock production facility and not on the highways. Trailers specially designed to move such equipment on highways shall, for the purposes of part 5 of article 4 of this title, be considered as component parts of such implements of husbandry. C.R.S. 42-1-102(44) Effective July 1, 2013 Senate Bill 10-177 extends the definition of Implement of Husbandry to include personal property valued by the County Assessor as silvicultural. Silviculture has several meanings but could be defined inclusively as “related to forestry”. Vehicles that are valued by the County Assessor as silvicultural will not be required to be titled or registered and specific ownership taxes and registration fees will not be collected.

Intestate

When an individual dies without leaving a will.

J

Joint Tenant

(JTWROS, Joint Tenants With Rights of Survivorship) C.R.S. 38-11-101 (1) An estate in joint tenancy in personal property is created if, in the instrument evidencing ownership of such property, it is declared that the property is conveyed, transferred, bequeathed, or held in joint tenancy or as joint tenants, whether or not additional words are used relating to tenancy in common or survivorship. The abbreviation “JTWROS” and the phrase “as joint tenants with right of survivorship” or “in joint tenancy with right of survivorship” shall have the same meaning. Upon the death of any such joint tenants, the title to and ownership of such personal property passes immediately to and vests in the surviving joint tenant or tenants. Any grantor or transferor in any such instrument of conveyance or transfer may also be one of the grantees or transferees therein. (3) Any such instrument evidencing ownership executed prior to July 1, 1996, as amended in compliance with subsection (1) of this section shall be deemed to have created an estate in joint tenancy.

Judgment

A determination made by a court of law; a judicial decision.

K

Kamikaze Boards

A motorized vehicle consisting of a low footboard on wheels, similar to a skateboard. Kamikaze boards are considered “toy vehicles” pursuant to C.R.S. . 42-1-102 (103.5).

Kit Vehicle

A passenger-type motor vehicle assembled, by other than a licensed manufacturer, from a manufactured kit that includes a prefabricated body and chassis and is accompanied by a manufacturer’s statement of origin. C.R.S. 42-1-102(45.5)

L

Lease

An agreement granting use or occupation of a vehicle during a specific period in exchange for a specific payment.

Lease Vehicle Agreement

A written contract between two (2) parties regarding the use of a motor vehicle. Lessor must be the titled owner of the vehicle who is allowing the use of the vehicle by the lessee for a specific time period and monetary exchange.

Legal Address

A person’s residence shall be the person’s principal or primary home or place of abode, to be determined in the same manner as residency for voter registration purposes as provided in sections 31-2-102 and 31-10-201, C.R.S. .; except that “voter registration” shall be substituted for “motor vehicle registration” as a circumstance to be taken into account in determining such principal or primary home or place of abode. C.R.S. 42-6-139(1)

Lessee

The person, firm, or corporation who has been granted the use of a vehicle during a specified period of time for a specified payment.

Lessor

The owner of a vehicle who is granting use of a vehicle during a specified period of time in exchange for a specified payment.

Letters of Administration

A legal document entrusting an individual with the administration of the estate of a decedent. This individual manages the estate of a deceased person who left no executor.

Letters of Conservatorship

A court order designating a person, official or institution to take over and protect the interests of an incompetent person.

Letters of Guardianship

A commission placing a ward’s property in care of a guardian or custodian. Letters of Guardianship are commonly used for the purpose of handling money and assets.

Letters of Testamentary

A court order designating a personal representative for a deceased person.

Lien

A security interest in a motor vehicle under article 9 of title 4, C.R.S., and this article. C.R.S. 42-6-102(7)

Lien Maturity Date

The date of which the lien expires.

Lien Release

Discharge of security or encumbrance upon property.

Limited Liability Company/LLC

LLCs are structured differently for the purposes of taxation and liability. Like owners of partnerships or sole proprietorships, LLC owners report business profits or losses on their personal income tax returns; the LLC itself is not a separate taxable entity. Like owners of a corporation, however, all LLC owners are protected from personal liability for business debts and claims – a feature known as “limited liability”. This means that if the business owes money or is named in a lawsuit for some other reason, only the assets of the business itself are at risk. Owners of a LLC are called members. Since most states do not restrict ownership, members may include individuals, corporations, other LLCs and foreign entities. A few types of businesses generally cannot be LLCs, such as banks, insurance companies and non-profit organizations. Secure and verifiable information is required for title and registration transactions conducted on a vehicle owned by a limited liability company. Secure and verifiable identification is required.

Limited Liability Limited Partnership

A Limited Liability Limited Partnership (LLLP) is defined as a LP (see above for requirements) that has registered as a LLLP under the Colorado Uniform Partnership Act with the State of Colorado. The attributes and restrictions of a LP will apply, except that all partners, not just the limited partners are shielded from personal liability for the obligations of the partnership. Secure and verifiable identification is required for title and registration transactions conducted on a vehicle owned by a limited liability limited partnership. Limited Liability Partnership

A Limited Liability Partnership (LLP) is a General Partnership in which the partners are not personally liable for the debts and obligations of the General Partnership. LLPs are formed by filing a Certificate of Limited Partnership and registering a Limited Liability Partnership registrations statement with the Secretary of State of Colorado. As with a General Partnership, decision making in a LLP is accomplished by a majority vote of the partners, and all partners have a statutory right to participate in the management of the business. Unless otherwise provided in the partnership agreement, all profits and losses are shared equally among the partners. The disassociation of a partner will not dissolve the partnership unless the disassociation will leave the partnership with only one partner. Secure and verifiable identification is required for title and registration transaction conducted on a vehicle owned by a limited liability partnership.

Limited Partnership

A Limited Partnership (LP) is a partnership in which there is at least one general partner who actively manages the business and who is personally liable for the obligations of the business and one or more limited partners who have no liability for the obligations of the business but cannot have an active role in managing the company. Only the general partner has the authority to bind or take an active role in managing the company. Only the general partner has the authority to bind or take action on behalf of the partnership. LPs are formed by filing a certificate of limited partnership with the state. As with all partnerships, LPs are governed by a partnership agreement among all of the partners. Unlike a general partnership, unless otherwise modified in the partnership agreement, the allocation of profits and losses in a LP is based on each partner’s contributions (value of cash, personal property or services) to the partnership. Unless provided for in the partnership agreement, a LP will survive the disassociation of a general partner or a limited partner. Upon the disassociation of the last remaining general partner, the limited partners may continue on, or may choose to dissolve the partnership by a majority vote of the remaining limited partners. Low–Power Scooter

A self-propelled vehicle designed primarily for use on the roadways with not more than three wheels in contact with the ground, no manual clutch, and either of the following:

(I) A cylinder capacity not exceeding fifty cubic centimeters if powered by internal combustion; or

(II) A wattage not exceeding four thousand four hundred seventy-six if powered by electricity.

(b) “Low-power scooter” shall not include a toy vehicle, bicycle, electrical assisted bicycle, wheelchair, or any device designed to assist mobility-impaired people who use pedestrian rights-of-way. C.R.S. 42-1-102 (48.5) (a)

Low-Speed Electric Vehicle

A vehicle that: 

(a) Is self-propelled utilizing electricity as its primary propulsion method; 

(b) Has at least three wheels in contact with the ground; 

(c) Does not use handlebars to steer; and 

(d) Exhibits the manufacturer’s compliance with 49 CFR 565 or displays a seventeen-character vehicle identification number as provided in 49 CFR 565. C.R.S. 42-1-102 (48.6)

M

Make

The registered name and/or trademark given to a vehicle by the licensed manufacturer.

Manufacturer

A person, firm, partnership, corporation, or association engaged in the manufacture of new motor vehicles, trailers, or semitrailers. C.R.S. 42-6-102(8)

Manufacturer’s Suggested Retail Price (MSRP)

The retail price of such motor vehicle suggested by the manufacturer plus the retail price suggested by the manufacturer for each accessory or item of optional equipment physically attached to such vehicle prior to the sale to the retail purchaser. C.R.S. 42-1-102(50)

Mastic Compound

Quick-drying, pasty cement used for cementing the Federal Sticker to a vehicle.

Maturity Date (Lien)

The date of which the lien expires.

Manufactured Home

Any pre constructed building unit or combination of preconstructed building units, without motive power, where such unit or units are manufactured in a factory or at a location other than the residential site of the completed home, which is designed and commonly used for occupancy by persons for residential purposes, in either temporary or permanent locations, and which unit or units are not licensed as a www.Colorado.Gov/revenue Page 18 ◆ Definitions Apr, 2014 vehicle. C.R.S. 42-1-102(106)(b)

MCO

Manufacturer’s Certificate of Origin (referred to in this manual as MSO).

Mileage History

The number of miles operated by a vehicle during the continuous twelve (12) month period immediately preceding the registration of the vehicle.

Mini-Bike

See Toy Vehicle C.R.S. 42-1-102 (103.5)

Mortgage

“Mortgage” or “chattel mortgage” means a security agreement as defined in section 4-9-102 (76), C.R.S. C.R.S. 42-6-102(9)

Mortgagee

The holder of a mortgage; commonly referred to as the lienholder.

Mortgagor

The borrower of funds; commonly referred to as the debtor.

Motorcycle

A motor vehicle that uses handlebars or any other device connected to the front wheel to steer and that is designed to travel on not more than three wheels in contact with the ground; except that the term does not include a farm tractor, low-speed electric vehicle, or low-power scooter. C.R.S. 42-1-102 (55)

Motor Home

A vehicle designed to provide temporary living quarters and which built into, as an integral part of or a permanent attachment to, a motor vehicle chassis or van. C.R.S. 42-1-102 (57)

Motor Number

This is the engine number of the vehicle, and is only used on vehicles which were manufactured in 1953 and prior years. It is not an acceptable identification number of vehicles manufactured in 1954 and later.

Motor Vehicle (1 of 2) 

Any self-propelled vehicle that is designed primarily for travel on the public highways and that is generally and commonly used to transport persons and property over the public highways or a low-speed electric vehicle. Does not include low-power scooters, wheelchairs or vehicles moved solely by human power. For purposes of the traffic offenses described in sections 42-2-128, 42-4-1301, 42-4-1301.1, and 42-4-1401 for farm tractors and off-highway vehicles, as defined in section 33-14.5-101(3), CRS, operated on streets and highways, “motor vehicle” includes a farm tractor or an off-highway vehicle that is not otherwise classified as a motor vehicle. For the purpose of sections 42-2-127, 42-2-127.7, 42-2-128, 42-2-138, 42-2-206, 42-4-1301, and 42-4-1301.1, “motor vehicle” includes a low-power scooter. C.R.S. 42-1-102 (58)

Motor Vehicle: (2 of 2) 

Any self-propelled vehicle that is designed primarily for travel on the public highways and is generally and commonly used to transport persons and property over the public highways, including trailers, semitrailers, and trailer coaches, without motive power. “Motor vehicle” does not include the following: (a) A low-power scooter, as defined in section 42-1-102; (b) A vehicle that operates only upon rails or tracks laid in place on the ground or that travels through the air or that derives its motive power from overhead electric lines; (c) A farm tractor, farm trailer, and any other machines and tools used in the production, harvesting, and care of farm products; or (d) Mobile machinery, self-propelled construction equipment, or industrial machinery not designed primarily for highway transportation. Mounted Equipment

Any item weighing more than five hundred pounds that is permanently mounted on a vehicle, including mounting by means such as welding or bolting the equipment to a vehicle. C.R.S. 42-1-102 (60)

MSO (Manufacturer’s Statement of Origin)

A certificate issued by the manufacturer of a motor vehicle which describes the vehicle and assigns it to a dealer, distributor, or individual.

MSRP (Manufacturer’s Suggested Retail Price)

The retail price of a motor vehicle suggested by the manufacturer plus the retail price suggested by the manufacturer for each accessory or item of optional equipment physically attached to such vehicle prior to the sale to the retail purchaser. C.R.S. 42-1-102 (50)

Multipurpose Trailer

A wheeled vehicle, without motive power, that is designed to be drawn by a motor vehicle over the public highways. A “multipurpose trailer” is generally and commonly used for temporary living or sleeping accommodation and transporting property wholly upon its own structure and is registered as a vehicle. C.R.S. 42-1-102 (60.3)

New Vehicle

A motor vehicle being transferred for the first time from a manufacturer or importer, or dealer or agent of a manufacturer or importer, to the end user or customer. A motor vehicle that has been used by a dealer for the purpose of demonstration to prospective customers shall be considered a “new vehicle” unless such demonstration use has been for more than one thousand five hundred miles. Motor vehicles having a gross vehicle weight rating of sixteen thousand pounds or more shall be exempt from this definition. C.R.S. 42-6-102(11)

Noncommercial or Recreational Vehicle

A truck or unladen truck tractor, operated singly or in combination with a trailer or utility trailer or a motor home, which truck, or unladen truck tractor, or motor home is used exclusively for personal pleasure, enjoyment, other recreation purposes, or personal or family transportation of the owner, lessee, or occupant and is not used to transport cargo or passengers for profit, hire, or otherwise to further the purposes of a business or commercial enterprise. Non-Conforming VIN

The VIN may be up to and including a 17 digit scheme, but does not comply with Federal specifications set up by the National Highway Traffic Safety Administration (NHTSA). Manufactured homes may have more than 17 digits.

Nonresident

Every person who is not a resident of this state. C.R.S. 42-1-102(62)

Notarial Acts

Those acts that a notary public is empowered to perform pursuant to section 12-55-110 (1). C.R.S. 12-55-102(1.5)

Notarization

The performance of a notarial act.

Notary

Any individual appointed and commissioned to perform notarial acts. C.R.S. 12-55-102(2)

Notary Public

Owner

A person who holds the legal title of a vehicle; or, if a vehicle is the subject of an agreement for the conditional sale or lease thereof with the right of purchase upon performance of the conditions stated in the agreement and with an immediate right of possession vested in the conditional vendee or lessee or if a mortgagor of a vehicle is entitled to possession, then such conditional vendee or lessee or mortgagor shall be deemed the owner for the purpose of articles 1 to 4 of this title. The term also includes parties otherwise having lawful use or control or the right to use or control a vehicle for a period of thirty days or more. C.R.S. 42-5-101(7) “Owner” means any person, firm, partnership, association, or corporation. Owner Name and Address

This is the legal full name of the owner, the address of the owner, the street number, street name, city or town, state and zip code.

Ownership Tax

An annual tax, in lieu of ad valorem taxes, imposed on personal property by section 6 of article X of the State Constitution. Commonly called Specific Ownership Tax (SOT). C.R.S. 42-3-101 and C.R.S. 42-3-106

Partnerships

Partnerships are technically defined as an association of two or more persons to act in the capacity of owners of a business for profit. There are several different types of partnerships, identified as: General Partnership, Limited Partnership, Limited Liability Partnership, Limited Liability Limited Partnership, Limited Liability Company/LLC

Person

A natural person, estate, trust, firm, co-partnership, association, corporation or business entity. C.R.S. 42-5-101(9) “Person” includes a partnership, company, corporation, or association. C.R.S. 42-6-102(13) “Person” means natural persons, associations of persons, firms, limited liability companies, partnerships, or corporations. C.R.S. 42-1-102(69)

Personal Representative

A person legally appointed to act on behalf of a deceased person.

Pocket Bikes

A mini-bike, sometimes called a mini moto or pocket bike, is a miniature motorcycle. Pocket bikes are considered “toy vehicles” pursuant to C.R.S. 42-1-102 (103.5)(a)(b)(c).

Political Subdivision

Counties, special districts, water conservation districts, irrigation districts, municipal corporations, school districts, and all other political subdivisions of the state. C.R.S. 30-26-503 Any entity of government authorized by law to impose ad valorem taxes on taxable property located within its territorial limits. C.R.S. 39-1-102(12)

Power of Attorney

A legal instrument authorizing one to act as the attorney or agent of the grantor.

Power Takeoff Equipment (PTO)

Equipment that is attached to a motor vehicle and is powered by the motor that powers the locomotion of the motor vehicle. C.R.S. 42-1-102(72.2)

Previous Title Number Field

The abbreviation of the supporting document surrendered to issue the current title document. (i.e.: MSO, Bill of Sale, Bond, Colorado Title Number, Out-of-State Title, etc.)

Probate

The procedure for formally establishing or proving the validity of a will.

Professional

A physician licensed to practice medicine or practicing medicine pursuant to section 12-36-106 (3) (i), C.R.S. (i) the performance by commissioned medical officers of the armed forces of the United States of America or of the United States public health service or of the United States veterans administration of their lawful duties in this state as such officers. A physician assistant licensed pursuant to section 12-36-107.4, C.R.S., a podiatrist licensed under article 32 of title 12, C.R.S., an advanced practice nurse registered pursuant to section 12-38-111.5, C.R.S., or a physician, physician assistant, podiatrist, or advanced practice nurse authorized to practice professionally by another state that shares a common border with Colorado.

Additional professionals for Short Term Placards only: Chiropractor licensed under article 32 of title 12, C.R.S and Physical Therapist licensed under article 32 of title 12, C.R.S Nurse Practitioner and Advanced Practice Nurse are the same.

Proprietary Interest

Total or partial ownership.

Public Administrator

The district or probate court in each judicial district may appoint a person who shall be known as the public administrator. The appointee shall be a qualified elector over twenty-one years of age and shall be a resident of or maintain a principal place of business in the judicial district in which the appointee is to act as public administrator. Unless authorized by the appointing court, the appointee shall remain a resident of or maintain a principal place of business in the judicial district in which the appointee has been appointed during the period in which the appointee holds the office of public administrator. The person appointed as the public administrator shall serve at the pleasure of the appointing court until discharged by the court or until such person’s resignation is accepted by the appointing court. Any person appointed as a public administrator shall not be considered an employee of either the state of Colorado or of the judicial district or the city or the county in which such person has been appointed public administrator because of his or her appointment as public 

Public VIN

The vehicle identification number that is accessible to view, i.e. usually located on the dash or door panel.

Purchase Date

The date the sale of the vehicle occurred.

Purchase Price

The sale amount of the vehicle.

R

Race Cars

These vehicles are not titled in Colorado, they do not meet the requirements of C.R.S. 42-6-102(10).

Real Property

The land and all rights referring to the land. A manufactured home mounted on a permanent foundation is considered real property.

Rebuilt Vehicle

A vehicle which has been assembled from parts of two or more commercially manufactured vehicles or which has been altered in such a manner that it is not readily recognizable as a commercially manufactured vehicle of a given year. “Rebuilt vehicle” includes a street rod vehicle. C.R.S. 42-5-201(8)

Reception No. (File No.)

The lien file number assigned in the County Motor Vehicle office to the chattel mortgage or security agreement.

Reciprocity

An agreement between two or more states, provinces or jurisdictions for coordinated, shared, or mutual enforcement of laws relating to registration, operation or taxation of vehicles in interstate commerce. The term includes without limitation the “International Registration Plan”.

Reciprocal Agreement (Reciprocity)

An agreement among two or more states, provinces, or other jurisdictions for coordinated, shared, or mutual enforcement or administration of laws relating to the registration, operation, or taxation of vehicles and other personal property in interstate commerce. The term includes without limitation the “international registration plan” and any successor agreement providing for the apportionment, among participating jurisdictions, of vehicle registration fees or taxes. C.R.S. 42-1-102(76)

Reconstructed Vehicle

A vehicle constructed from two or more commercially manufactured vehicles of the same type and year which has not been altered and which is recognizable as a commercially manufactured vehicle of a given year. C.R.S. 42-1-102(77) “Reconstructed vehicle” means any vehicle which has been assembled or constructed largely by means of essential parts, new or used, derived from other vehicles or makes of vehicles of various names, models, and types or which, if originally otherwise constructed, has been materially altered by the removal of essential parts or by the addition or substitution of essential parts, new or used, derived from other vehicles or makes of vehicles. C.R.S. 42-5-201(9)

Redemption

The buying back of one’s property, which has been sold because of default.

Registration Period (Registration Year)

Any consecutive twelve-month period. C.R.S. 42-1-102(78)

Registration Period Certificate

The document issued by the department to a fleet owner, upon application of a fleet owner, which states the month in which registration is required for all motor vehicles owned by the fleet owner. C.R.S. 42-1-102(79)

Repossession

The lienholder takes possession of property, due to default on payments. C.R.S. 42-6-146.

Resident

Means any person who owns or operates any business in this state or any person who has resided within this state continuously for a period of ninety days or has obtained gainful employment within this state, whichever shall occur first. C.R.S. 42-1-102(81)

Restricted Title

A title that limits dealer reassignments, i.e., only dealers from that state are allowed to make a dealer reassignment, or does not allow dealer reassignments to be completed on a separate dealer bill of sale, requiring the last assigned dealer to establish title.

Retail Dealer

A dealer that can sell to the public or other dealers and auctions from a public place.

Rider

A document executed by the bonding company and intended to be attached to the bond for the purpose of changing it in some respect.

Roadworthy

A condition in which a motor vehicle has sufficient power and is fit to operate on the roads and highways of this state after visual inspection by appropriate law enforcement authorities. In order to be roadworthy, such vehicle, in accord with its design and use, shall have all major parts and systems permanently attached and functioning and shall not be repaired in such a manner as to make the vehicle unsafe.  For purposes of this subsection (15), “major parts and systems” shall include, but not be limited to, the body of a motor vehicle with related component parts, engine, transmission, tires, wheels, seats, exhaust, brakes, and all other equipment required by Colorado law for the particular vehicle. C.R.S. 42-6-102(15)

S

Salvage Vehicle

Damaged by collision, fire, flood, accident, trespass, or other occurrence, excluding hail damage, to the extent that the cost of repairing the vehicle to a roadworthy condition and for legal operation on the highways exceeds the vehicle's fair market value immediately prior to such damage, as determined by the person who owns the vehicle at the time of such occurrence or by the insurer or other person acting on behalf of such owner. (See C.R.S. 42-6-102(6), (10), (17), and (23).

S-Corporations/S-Corp

An S-Corporation is a regular corporation that has elected “S-Corporation” tax status. The ‘S’ in S-Corporation refers to Subchapter ‘S’ in the tax code. Forming a S-Corporation allows the owner to enjoy the limited liability of a corporate shareholder but pay income taxes as a sole proprietor or a partner. In a S-Corporation, all business profits “pass through” to the owners, who report them on their personal tax returns (as in sole proprietorships, partnerships and LLCs). The S-Corporation itself does not pay any income tax, although an S-Corporation with more than one owner must file an informational tax return like a partnership or LLC, to report each shareholder’s portion of the corporate income. School Bus

A motor vehicle that is designed and used specifically for the transportation of school children to or from a public or private school or a school-related activity, whether the activity occurs within or without the territorial limits of any district and whether or not the activity occurs during school hours. "School bus" does not include informal or intermittent arrangements, such as sharing of actual gasoline expense or participation in a car pool, for the transportation of school children to or from a public or private school or a school-related activity. C.R.S. 42-1-102(88)

Second Lien of Record Filed to

The name and address of the second lienholder as shown on the chattel mortgage or security agreement.

Second or other Junior Mortgages

Such second or junior mortgagee or the holder thereof shall file said mortgage pursuant to the requirements of section 42-6-121 with the director’s authorized agent of the county wherein the mortgagor of said motor vehicle resides or where the motor vehicle is located and shall accompany said mortgage with a written request to have the existence thereof noted or filed on the certificate of title records of the director’s authorized agent pertaining to the motor vehicle covered by the junior or second mortgage. Upon the filing of such mortgage, the director’s authorized agent shall note in the record of the subject vehicle the day and hour on which such mortgage was received by the agent and shall make and deliver a receipt for the mortgage to the person filing the mortgage, and shall file the second or junior mortgage as required under section 42-6-122. C.R.S. 42-6-129

Secure and Verifiable Identification (SVID)

A document issued by a state or federal jurisdiction or recognized by the United States government and that is verifiable by federal or state law enforcement, intelligence, or homeland security agencies. See DR 2841

Semi-trailer

Wheeled vehicles, without motive power, designed to be pulled by truck tractors; used to transport property and goods over the highways.

Sole Proprietorship

A sole proprietorship is a company which is owned by one person and is not registered with the state as a limited liability company (LLC) or a corporation. In some states, a sole proprietorship is referred to as a DBA (doing business as), such as “Jose Smith, doing business as Smith Heating and Air Conditioning”. Business may also be conducted in the owner’s name, for example “Jim Poznak Plumbing” or under a trade name, such as “EZ Plumbing”. The most important characteristic of a sole proprietorship is that the law makes no distinction between the sole proprietor and the business. Therefore, the sole proprietor is personally liable for all debts and acts of the company. If a sole proprietor defaults on a debt or is sued, and the plaintiff prevails, the plaintiff or lender may satisfy the judgment with the sole proprietor’s personal assets (home, car, bank accounts and other personal property). Secure and verifiable identification is required.

SOT (Specific Ownership Tax)

An annual tax, in lieu of ad valorem taxes, imposed on personal property by section 6 of article X of the State Constitution. Commonly called Specific Ownership Tax (SOT).

Special ID for Trailers and Manufactured Homes

A special VIN tag issued by the County Motor Vehicle office for homemade trailers, or manufactured homes and trailers with obliterated or missing identification numbers. Begins with ID and ends with two alpha characters.

Special Mobile Machinery (SMM)

Machinery that is pulled, hauled, or driven over a highway and is either:

1) A vehicle or equipment that is not designed primarily for the transportation of persons or cargo over the public highways; or

2) A motor vehicle that may have been originally designed for the transportation of persons or cargo over the public highways, and has been redesigned or modified by the addition of mounted equipment or machinery, and is only incidentally operated or moved over the public highways.

Special Mobile Machinery includes vehicles commonly used in the construction, maintenance, and repair of roadways, the drilling of wells, and the digging of ditches. C.R.S. 42-1-102(93.5)

Stand-up Scooter

A two-wheeled vehicle that has handlebars, is designed to be stood on by the operator, and is powered by either a small Electric or Gasoline Engine. Stand-up scooters are considered “toy vehicles” pursuant to C.R.S. . 42-1-102 (103.5).

Statement

In a general sense, an allegation; a declaration of matters of fact.

Statement of Error

Statement explaining a mistake in procedure, and what the correction should be.

Statement of Fact

Statement explaining the complete history of the situation.

Statement of One and the Same

A statement indicating variations in a name, either by a person or company, affirming that they are all one in the same.

Street Rod Vehicle

A vehicle with a body design manufactured in 1948 or earlier or with a reproduction component that resembles a 1948 or earlier model that has been modified for safe road use, including modifications to the drive train, suspension, and brake systems, modifications to the body through the use of materials such as steel or fiberglass, and modifications to other safety or comfort features. C.R.S 42-12-101(14)

Special Districts

In Colorado are local governments, i.e., political subdivisions of the state, which make up a third level of government in the United States. (The federal and state governments are the other two levels.) Local governments include counties, municipalities (cities and towns), school districts, and other types of government entities such as "authorities" and "special districts." Colorado law limits the types of services that county governments can provide to residents. Districts are created to fill the gaps that may exist in the services counties provide and the services the residents may desire. The majority of districts draw their boundaries in unincorporated county land, but residents of a municipality may be included in one or more districts. As political subdivisions of the State of Colorado, special districts are required to submit a number of required filings to various state agencies throughout the year. These filings are primarily financial, but also include election results, lists of boards of directors, and others.

Successor

Those persons legally specified to receive the estate of a decedent.

Supporting Document

A written or printed paper furnishing information or evidence; a legal or official paper.

Surety Bond

A written instrument with sureties guaranteeing performance of acts of duties. A surety bond issued by one party, the surety, guaranteeing that he will perform certain acts promised by another, or pay a stipulated sum, up to the bond limit, in lieu of performance should the principal fail to perform.

T

Taxable Value

The base amount that is used to calculate annual specific ownership tax. Once the taxable value for a vehicle is determined, it never changes. For more information, see C.R.S. 42-3-106

Tenants in Common

When one owner of a vehicle dies, the deceased’s share of the vehicle goes to his heirs, not necessarily the other person shown on the title if they are tenants in common. If the Certificate of Title does not indicate JTWROS, the owners are tenants in common.

Title Number

This is a unique number assigned to each Colorado Motor Vehicle title transaction, issued in numerical sequence by the County Motor Vehicle office. The configuration is: the two-digit County designation numbers are the first two numbers, followed by an alpha character, and the six-digit consecutive, sequential number.

Toy Vehicle

Any vehicle that has wheels and is not designed for use on public highways or for off-road use. (b) “Toy vehicle” includes, but is not limited to, gaspowered or electric-powered vehicles commonly known as mini bikes, “pocket” bikes, kamikaze boards, go-peds, and stand-up scooters. (c) “Toy vehicle” does not include off-highway vehicles or snowmobiles. C.R.S. 42-1-102 (103.5)

Trailer

Any wheeled vehicle, without motive power, which is designed to be drawn by a motor vehicle and to carry its cargo load wholly upon its own structure and which is generally and commonly used to carry and transport property over the public highways. The term includes, but is not limited to, multipurpose trailers as defined in subsection (60.3) of this section. C.R.S. 42-1-102 (105)

Trailer Coach

A wheeled vehicle having an overall length, excluding towing gear and bumpers, of not less than twenty-six feet without motive power, that is designed and generally, and commonly used for occupancy by persons for residential purposes, in temporary locations, and that may occasionally be drawn over the public highways by a motor vehicle and is licensed as a vehicle. C.R.S. 42-1-102-(106)(a)

Truck

Any motor vehicle equipped with a body designed to carry property and which is generally and commonly used to carry and transport property over the public highways. C.R.S. 42-1-102(108)

Truck Tractor - Laden or Laden Truck Tractor

“Truck tractor - laden” or “laden truck tractor” means any motor vehicle carrying cargo that is generally and commonly designed and used to draw, and is drawing, a semitrailer or trailer and its cargo load over the public highways. C.R.S. 42-1-102(109)

Truck Tractor - Unladen or Unladen Truck Tractor

Any motor vehicle not carrying cargo that is generally used to draw a semitrailer or trailer and its cargo load over the public highways. C.R.S. 42-1-102 (109.5)

Trust

Any express trust created by a will, trust instrument, or other instrument, whereby there is imposed upon a trustee the duty to administer a trust asset, for the benefit of a named or otherwise described income or principal beneficiary, or both. A trust shall not include trusts for the benefit of creditors, resulting or constructive trusts, business trusts where certificates of beneficial interest are issued to the beneficiary, investment trusts, voting trusts, security instruments such as deeds of trust and mortgages, trusts created by the judgment or decree of a court, liquidation or reorganization trusts, or trusts for the sole purpose of paying dividends, interest, interest coupons, salaries, wages, pensions, or profits, instruments wherein one or more persons are mere nominees for another, or trusts created in deposits in any banking institution or savings and loan institution. Trustee

A person or agent holding legal title to property in order to administer it for a beneficiary.

Trustee in Bankruptcy

An impartial person elected to administer the bankrupt persons’ estate.

U

Unladen

Unloaded; not carrying cargo.

Unrestricted Title

A title that does not limit dealer reassignments or use of additional dealer bills of sale.

Used Vehicle

Every motor vehicle which has been sold, bargained for, exchanged, or given away, or has had the title transferred from the person who first acquired it from the manufacturer or importer, and has been so used as to have become what is commonly known as “secondhand” within the ordinary meaning thereof. A motor vehicle that has been used by a dealer for the purpose of demonstration to prospective customers shall be considered a “used vehicle” if such demonstration use has been for more than one thousand five hundred miles.( See C.R.S. 42-1-102(110) and C.R.S 42-6-102(22)

Utility Trailer

Any wheeled vehicle weighing two thousand pounds or less, without motive power, which is designed to be drawn by a motor vehicle and which is generally and commonly used to carry and transport personal effects, articles of household furniture, loads of trash and rubbish, or not to exceed two horses over the public highways. C.R.S. 42-1-102(111)

V

Vehicle

Any device that is capable of moving itself, or of being moved, from place to place upon wheels or endless tracks. “Vehicle” includes, without limitation, a bicycle, electrical assisted bicycle, or EPAMD, but does not include a wheelchair, off-highway vehicle, snowmobile, farm tractor, or implement of husbandry designed primarily or exclusively for use and used in agricultural operations or any device moved exclusively over stationary rails or tracks or designed to move primarily through the air. C.R.S. 42-1-102 (112)

Vehicle Identification Number (VIN)

Any identifying number, serial number, engine number, or other distinguishing number or mark, including letters, if any, that is unique to the identity of a given vehicle or component part thereof that was placed on a vehicle or engine by its manufacturer or by authority of the department of revenue pursuant to section 42-5-205 or in accordance with the laws of another state or country. Verification of Vehicle Identification Number, REGULAR

The department may require those vehicle-related entities specified by regulation to verify information concerning a vehicle through the physical inspection of such vehicle. The information required to be verified by such a physical inspection shall include the vehicle identification number or numbers, the make of vehicle, the vehicle model, the type of vehicle, the year of manufacture of such vehicle, the type of fuel used by such vehicle, the odometer reading of such vehicle, and such other information as may be required by the department. For the purposes of this paragraph (b), "vehicle related entity" means an authorized agent or designated employee of such agent, a Colorado law enforcement officer, a licensed Colorado dealer, a licensed inspection and readjustment station, or a licensed diesel inspection station. 42-6-107(1)(b) Verification of Vehicle Identification Number, CERTIFIED: See CERTIFIED VIN INSPECTION

The empty weight of the vehicle.

Weight Slip

A receipt from a certified public scale, identifying the vehicle, and showing the empty weight of the vehicle.

Wholesale Dealer

A dealer licensed to sell only to other dealers and auctions.

Witness

One who signs his name to a document for the purpose of attesting to its authenticity.

Writ

A written order issued by a court, commanding the party to whom it is addressed to perform, or cease performing some specified act.

The vehicle year as designated by the manufacturer, or in the case of a homemade vehicle, the year of application.
