Chapter 84. Health Services Advisory Board of the Township of Gloucester

BE IT ORDAINED by the Township Council of the Township of Gloucester in the County of Camden, State of New Jersey, that a new Chapter 84 entitled, “Health Services Advisory Board” be and is hereby created as follows:

SECTION 1. That Section 84-1, entitled, “TITLE” to read as follows:

There is hereby established and confirmed the creation of an advisory board to be known as the “Health Services Advisory Board of the Township of Gloucester.”

SECTION 2. That Section 84-2, entitled, “PURPOSE” to read as follows:

“It is hereby found an declared there exists a need in the Township of Gloucester for an advisory board to provide health services pursuant to N.J.S.A. 26:3A2-1 et seq. and to designate Camden County Health Department as the designated entity to provide compliance with the Health Services Act of the State of New Jersey,

Section 3. That Section 84-3, entitled, ‘MEMBERSHIP” to read as follows:

The Health Services Advisory Board shall consist of five (5) members, to be appointed by the Mayor with the advice consent of the Township Council. The persons so appointed shall citizens of the State of New Jersey and residents of the Township of Gloucester. The term of office of the five members shall be staggered and not more than four years. For the initial appointment following the effective date of this ordinance, one member shall be appointed for a term to end December 31, 2016, thereafter the term shall be for four years; two members shall be appointed for a term to end December 31, 2017, thereafter the term shall be for four years’ and two members shall be appointed for a term to end December 31st, 2018, thereafter the term shall be four years. A vacancy in membership shall be filled for the unexpired term only. Appointment to a vacant seat shall be filled in the same manner as the original appointment.

SECTION 4. The Health Services Advisory Board shall have the following “duties.” The Health Services Advisory Board shall cooperate with the Camden County Health Department to provide a program of health services in compliance with the New Jersey Health Services Act. The Health Services Advisory Board may from time to time serve as liaison between the Camden County Health Department and the Mayor and Township Council of the township of Gloucester in an effort to promote the enforcement of any and all County Health regulations. The Health Services Advisory Board shall perform any and all related functions necessary to meet the standards of performance under the New Jersey Health Services Act.

SECTION 5. ‘DESIGNATION OF LOCAL PROVIDER”

Pursuant to N.J.S.A. 26:3A-10, the Camden County Health Department is hereby designated as the entity responsible for local compliance with the New Jersey Health Services Act and for any and all functions which would be performed by a local health service provider, including standards of performance.

SECTION 6. All ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of such inconsistency.

SECTION 7. If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgement of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance.

SECTION 8. This ordinance shall take effect immediately after final passage and publication as required by law.
