Be it ordained by the Township Council of the Township of Gloucester, in the County of Camden and State of New Jersey, as follows:

ARTICLE I Police Department Records

§ 51-1. Fees Established; obligation of custodian.

A. The following fees which are to be prepaid by the requestor are established for the furnishing of copies of records, reports, documents, photograph and other services prepared, maintained and performed by the Police Department of the Township of Gloucester:

The fee shall be determined by the cost incurred by the Township.

This fee shall include the cost of materials necessary to prepare and deliver said request.

The agency of person making the request will be billed in advance so that the agency or person making the request will be fully aware of the cost(s) involved.

9. Request to impound video tapes, sound recordings, etc.:

When a request is made, in writing, to impound a video tape sound recording, etc., the agency or person making the request shall reimburse the Township for the current market price of the item being impounded so that the operation of the Township shall not be impeded.

B. Unusual Requests for Documents

1. The fee for exceptional or unusual requests for review of records and/or copies shall be determined on a case by case basis.

2. All fees hereunder shall be estimated and pre-paid by requestor. If estimated sums exceed actual cost, excess shall be refunded. If estimated cost and expense incurred by the Township, requestor shall pay the difference immediately upon deliver of the documents or materials.

C. Postage

If copies of reports are requested other than in person, an additional fee shall be charged to cover the cost of mailing the request. This additional fee shall be determined by the current postage rate at the time of mailing.

D. Exempted Materials

The establishment of the foregoing fees shall in no way be construed as obligating the custodian of the records to provide such records, reports, documents, photographs, tape recordings or video recordings, when the records, documents, etc., are evidential reports and the case is pending further investigation and/or court disposition or when the matter may be pending Grand Jury or criminal court action and written consent of the Prosecutor of the County is necessary or when otherwise limited by law.

§ 51-2 Exemption from payment of fees.

No charge or fee shall be made for the furnishing of copies of records, reports, documents, photographs and other information to any federal, state, county or municipal law enforcement department or agency.

§ 51-3 Requests for copies of records.

All requests for copies of records, reports, documents, photographs and other services prepared, maintained and performed by the Police Department of the Township of Gloucester shall be made and directed to the Police Record Division of said Police Department. All requests must provide sufficient and accurate data for the search and furnishing of the same, such as the names of the drivers, the time, location and date of the accident or incident, the name of the defen­dant, the summons number, the date of the violation, etc.

§ 51-4 Payment of fees.

All fees shall be pre-paid by requestor. All fees shall be payable to the Township of Gloucester and presented to and collected by the Treasurer of the Township of Gloucester who shall issue a duplicate receipts therefore, one (1) of which shall be given by the Treasurer or person making the request to the custodian of the records in the Police Record Division of the Police Department.

§ 51-5 Severability

If any Article, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision or invalidity shall not affect the remaining portions or provisions of this ordinance.

§ 51-6 Repealer

All ordinance and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency.

§ 51-7 When Effective

This ordinance shall take effect immediately after final passage and publication in accordance with the laws of the State of New Jersey.

First criteria for all applicants regardless of category above, 75% of all participants/players on roster must be from Gloucester Township.

Any damages, services, will be billed accordingly. Fees not paid within (30) days of event will cause prohibition from continuous and future use of the fields or gazebo.

Cancellation/No Show Policy

It is the responsibility of the group to review the Permit when received with the approved dates and times for the Recreation Center.

It is imperative for groups to understand the importance of canceling in a timely manner. Unless the group gives seven (7) working days notice of the cancellation (non-weather related), the group will be charged $30.00 per hour for the unused time. It would be the same in the case, if group does not show up or call at all.

§ 51-9. Collection and deposit.

The fee charges herein shall be collected by the Department of Recreation and deposited forthwith with the Department of Adminis­tration and Finance at the direction of the Mayor. Said charges shall be on an individual per person basis except where specified as a group or team rate.

§ 51-10. Refunds.

Full refunds will be issued when the program is canceled by the Department of Recreation due to lack of registrants. In the event the regis­trant cannot attend or dislikes the program, the registrant must notify the Department of Recreation.

Refunds are as follows:

(a) if the Registrant withdraws prior to 20% of the class or program being scheduled; a full refund less a $10.00 processing fee will be returned.

(b) if the Registrant withdraws after 20% of the class or program is scheduled, no refund will be made.[Amended on 06-14-04 by Ord. O-04-12]

§ 51-11. Payment of fees required.

No person except full-time employees of the Department of Recreation shall participate in any of the programs or sports set forth herein without prepayment of the fee or fees as established pursu­ant to this ordinance, and the Director of the Department of Recre­ation at the direction of the Mayor shall enforce the provisions hereof and shall have the power to exclude from participation any person failing to pay for the fees prescribed herein.

§ 51-12. Repealer.

All ordinances or parts of ordinances inconsistent with this ordinance are hereby repealed to the extent that said ordinances are inconsistent with provisions hereof.

§ 51-12.1 When effective.

This ordinance shall take effect immediately upon final passage by Township Council, approval by the Township Mayor and publication as provided by law.

ARTICLE III Reproduction of Public Records

§ 51-13. Photocopying charges; removal of records for photocopying.

A. Charges for photocopying existing records and documents by custodian shall be as follows:

$.05 per letter size page

$.07 per legal size page

B. Charges for Computer Printouts

Not exceeding 3 pages $10.00

Each additional page 1.00

C. Unusual Requests

If the custodian of such records shall find that there is no risk of damage or mutilation of such records and that it would not be incompatible with the economic and efficient operation of the office and transaction of public business therein, he may permit any citizen who is seeking to copy more than one hundred (100) pages of records to use his own photographic process, approved by the custodian, upon the payment of a reasonable fee considering the equipment and the time involved, to be fixed by the custodian of not less than fifteen dollars ($l5.00.) nor more than fifty dollars ($50.00) per day. The fee to be based on the hourly rate of the records room employee assigned to assist the requestor.

§ 51-14. Duplication of cassette recordings.

Duplication of cassette recordings shall be "actual cost" for each cassette, computer disc, CD-ROM, or DVD's.

§ 51-15 Requests for copies of records

All requests for copies of records, reports, documents, photograph and other services prepared, maintained and performed by Non-Police Department custodian of the Township of Gloucester shall be made and directed to the Township Clerk. All requests must provide sufficient and accurate data for the search.

§51-16. Payment of fees.

§ 51-17.Repealer.

All ordinances and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency.

§ 51-18. Severability.

ARTICLE IV Youth and Family Services Program

§ 51-20. Fees.

§ 51-21. Inability to pay.

If an individual, couple or family is unable to pay the fees herein above set forth because of hardship as determined by the Direc­tor of Youth and Family Services, then the aforesaid fees may be waived by said Director, and said services shall be provided without prepayment of fees.

§ 51-22. Prepayment.

All fees shall be prepaid to the Secretary of Youth and Family Services Division before commencement of any counseling session. All fees received shall be transmitted to the Treasurer of the township at the end of each day.

§ 51-23. Effective date of fee schedule.

The fee schedule herein established shall not be made effective until January 1, 1983. Any individual, couple or family case for counseling taken after said date shall be subject to payment of the fees herein established unless payment is waived pursuant to § 51-19 of this ordinance.

§ 51-24. Failure to keep appointment.

Any individual, couple or family who fails to keep a scheduled counseling session and fails to give at least twenty-four (24) hour's notice of cancellation of such appointment shall be subject to payment of one-half (½) the amount of the fee, which would otherwise be required to be paid by said individual, couple or family.

§ 51-25. Severability.

If any section or part of this ordinance shall be declared invalid by the judgement of any court of competent jurisdiction, such section or part shall be deemed to severable from the remainder of the ordinance.

§ 51-26 Repealer.

All ordinances or parts of ordinances inconsistent with this ordinance are hereby repealed to the extent of such inconsistency only, but all ordinances and resolution to the extent that they are not inconsistent shall remain in full force and effect.

§ 51-27 When effective.

This ordinance shall take effect twenty (20) days after final adoption by the Township Council, approval and signing by the Mayor and publication, as provided by law.

§ 51-29. Repealer.

All ordinances and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency.

§ 51-30. Severability.

If any section, subsection, part, clause or phrase of this ordinance shall be declared invalid by judgement of any court of competent jurisdiction, such section, subsection, part clause or phrase shall be deemed to be severable from the remainder of this ordinance.

§ 51-31. When effective.

This ordinance shall take effect immediately after final passage and publication as required by law.

ARTICLE VI Office of the Public Defender

§ 51-32 Fees.

The Municipal Court Administrator shall assess a $50.00 fee, per application, to each person for whom an application for the services of the Municipal Public Defender is made. The fee shall be non-waivable by the Municipal Court Judge. The assertion by the applicant/defendant that he is unable to pay the application fee shall in no way affect or reduce the rendering of services to him by the Municipal Defender.

If the Municipal Court Administrator is unable to collect the fee charged at the time the application for services is made, the fee shall be collected in the manner provided in Section l, P.L. 1981, (N.J.S.A. 40:6A-1) and section 19 of P.L. 1967 (N.J.S.A. 2A: 158A-19).

The monies collected shall be for the use of the Municipality in administering the public defender system.

§ 51-33 Repealer

All ordinances and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency.

§ 51-34 Severability.

If any section, part, clause or phrase of this ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection part, clause or phrase shall be deemed to be severable from the remainder of this ordinance.

§ 51-35 When Effective.

This ordinance shall take effect immediately after final passage and publication as required by law.

§51-49 Repealer

All ordinances and provisions thereof inconsistent with the provisions of this Ordinance shall be and are hereby repealed to the extent of such inconsistency.

§51-50 Severability

If any section, subsection or part, clause or phrase of this Ordinance shall be declared invalid by judgment of any court of competent jurisdiction, such section, subsection, part, clause or phrase shall be deemed to be severable from the remainder of the ordinance.

§51-51 When Effective

This Ordinance shall take effect immediately after final passage and publication as required by law.

§51-56 Fees

Landlord Registration $50.00

§51-56.A. Fines and Penalties

Any landlord who shall violate any of the provisions of this Article shall, upon conviction thereof, be fined not exceeding five hundred dollars ($500.00) for each offense as may be issued through the Municipal Court of the Township of Gloucester, the Superior Court of New Jersey or other courts of competent jurisdiction.[Added on 01-28-08 by Ord. §51-56.B.

It is the intent and purpose of this Ordinance to adopt for enforcement by and through the Township of Gloucester, the provisions of N.J.S.A. 46:8-28 and as may be amended from time to time, providing for and mandating that every landlord within the jurisdiction of the Township of Gloucester shall comply with the provisions of landlord registration by filing with the Clerk of the Township of Gloucester information provided for in N.J.S.A. 46:8-28.[Added on 01-28-08 by Ord. §51-57 Repealer

Vendor Participating in all three newsletters $1,200.00

The Township of Gloucester reserves the right to refuse any advertisement it deems inappropriate as to content, style, design [e.g. no tobacco/alcohol advertisement) and/or as may be determined as not in keeping with the newsletter information bulletin.

§51-61 Repealer

If any Article, section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision or invalidity shall not affect the remaining portions or provisions of this ordinance.

All ordinance and provisions thereof inconsistent with the provisions of this ordinance shall be and are hereby repealed to the extent of such inconsistency.

§ 51-67 When Effective

This ordinance shall take effect immediately after final passage and publication in accordance with the laws of the State of New Jersey.
