Meal Break
The meal break for Non-Exempt STAFF who work more than 5 hours a day is (30) minutes and is unpaid. If Non-Exempt STAFF is scheduled for work less than six (6) hours, the meal break can be waived by mutual consent of both STAFF and Management. Business conditions may make it impossible to maintain strict uniformity in the hours of the meal break. Therefore, Management may authorize variations in the schedule.
Non-Exempt STAFF must be completely relieved from duty during meal break and STAFF may not unilaterally elect to work through any meal break. Any on-duty meal break must be mutually agreed upon in advance and in writing between the STAFF and the Management.
Break Times
In accordance with state law, Non-Exempt Staff Members in California are provided paid rest breaks. Although Staff Members are required to remain on the Company premises during the rest break, they may leave their work area. Within every four (4) hours worked, the Staff Member may take a ten (10) minute rest break. Rest breaks may not be combined with or added on to the lunch break. Nor may the rest break be used to allow a Staff Member to come in to the office/store ten (10) minutes late or leave ten (10) minutes early.
Breaks will be provided according to the number of hours worked, as follows:
