Paid Sick Leave
All STAFF
Eligible Employees
All STAFF who have worked in California for 30 or more days within a year from the start of their employment will be entitled to paid sick time.
However, STAFF are not eligible to take paid sick time until they have worked for the Company for 90 days from their date of hire.
Sick Pay Amount
Eligible STAFF will receive sick leave as follows:
In the first calendar year of employment, the Company will provide eligible STAFF with 48 hours of paid sick time on their first day of employment with the Company. You will need to meet the 90 day employment requirement before taking any leave. Beginning the second calendar year of employment, the Company will grant 48 hours of paid sick time to all eligible STAFF as of January 1 each year.
Unused sick time may be carried over to the following calendar year up to 72 hours in total accrual balance. However, sick time that STAFF can use is limited to 48 hours in a calendar year.
The Company does not pay employees for unused paid sick time at the end of the calendar year or at separation from employment.
Qualifying Reasons for Paid Sick Leave
Paid sick time can be used for the following reasons:
Diagnosis, care or treatment of an existing health condition for a STAFF or covered family member, as defined below.
Preventive care for a STAFF or a STAFF’s covered family member.
For certain, specified purposes when the STAFF is a victim of domestic violence, sexual assault or stalking.
For purposes of paid sick leave, a covered family member includes:
-A child defined as a biological, foster or adopted child; a stepchild; or a legal ward, regardless of the age or dependency status of the child. A "child" also may be someone for whom you have accepted the duties and responsibilities of raising, even if he or she is not your legal child.
-A "parent" defined as a biological, foster or adoptive parent; a stepparent; or a legal guardian of a STAFF or the STAFF's spouse or registered domestic partner. A parent may also be someone who accepted the duties and responsibilities of raising you when you were a minor child, even if he or she is not your legal parent.
-A spouse.
-A registered domestic partner.
-A grandparent.
-A grandchild.
-A sibling.
Sick leave will be paid only for approved absences. 2nd Street USA, Inc. may require STAFF to provide a health care provider’s statement for verification of absences of three (3) or more consecutive workdays.
Use of Paid Sick Leave
If the need for paid sick leave is foreseeable, STAFF shall provide advance oral or written notification to the management. If the need for paid sick leave is not foreseeable, STAFF shall provide notice to the management by calling the site sick line as soon as practicable.
An employee's use of paid sick time may run concurrently with other leaves under local, state or federal law.
Incremental Use
Paid sick leave can be used in 2 hours increment.
Other
Individuals rehired to work for the Company will be entitled to any unused paid sick time previously had at the time of separation if they are rehired within twelve (12) months after separation of employment.
Under no circumstance, will any retaliation or adverse action be taken against any STAFF Member for requesting or using available sick time. Any STAFF Member who feels that he/she has been retaliated is encouraged to bring his/her concern to the attention of the Direct Supervisor or Management promptly.
