HIPAA
In accordance with the Rules and Regulations relating to Standards of Nursing Practice in Rule 217.11 (1 E) * regarding unprofessional conduct, “Respect the client's right to privacy by protecting confidential information unless required or allowed by law to disclose the information”; the faculty of the Registered Nursing program has adopted the following policy:
Except in the structured, teaching-learning situation, all aspects of the patient/client’s medically-related information and/or data shall not be discussed with any other person or persons under any circumstance.
Failure to honor this basic ethical right of the patient/client may result in the immediate dismissal of the student from the ADN program.
The patient/client will not be referred to by name.
All information in regard to specific patients from the clinical setting will be regarded as confidential patient information and as such will be protected from discovery by or displayed to others in an inappropriate fashion. All information regarding specific patients/clients from the clinical setting will be regarded as confidential information and as such MAY NOT BE DISCUSSED OR REVEALED TO ANYONE OTHER THAN YOUR INSTRUCTOR OR CLASSMATES IN POST CONFERENCE.
COPIES OF MEDICAL RECORDS OR PATIENT LISTINGS WILL NOT BE MADE OR TAKEN OUT OF THE CLINICAL FACILITY. NO PORTION OF THE MEDICAL RECORD WILL BE PHOTOGRAPHED OR DOWNLOADED.
A HIPAA violation or breach of confidentiality may constitute Immediate dismissal from the TSTC ADN program without readmission and/or turned over to TBON. All suspected HIPAA violations must be immediately reported to the Program Team Lead and Program Director. Students have been instructed in HIPAA standards and should treat all patient information accordingly.
