ABSTRACT
It is a Research Project financed by FAP-DF with the proposal of investigate the potential of the legal instruments in the improvement, adaptation and implementation in the regulatory framework of water management, basic sanitation management and mining management in the Federal District. They are, therefore, areas that are independent of each other, but with repercussions on each other, thus deserving joint attention. The objective of this study is to investigate the empirical study of the legal norm for real problems in the Federal District that involve water security, basic sanitation and mining, with the purpose of suggesting solutions in the application of law in the face of the main problems that make up the interface between hydro intensive ventures mining and the application and formulation of water management instruments. Specifically, the proposal addresses the interface between environmental and mineral legislation with the protection of water resources and the need to rationalize access and distribution of water to the instruments of the National Water Resources Policy. It involves literature review, systematization of data, proposition of legal instruments of improvement and adaptation, as well as analysis of judicial interpretation on the themes.
RESUMO
Trata-se de Projeto de Pesquisa financiado pela FAP-DF, com a participação de três bolsistas, com a proposta investigativa do potencial dos instrumentos jurídicos no aperfeiçoamento, adaptação e implementação no marco regulador da gestão hídrica, gestão de saneamento básico e gestão da mineração no Distrito Federal. São, pois, áreas independentes entre si, mas que podem repercutir uma na outra, merecendo, portanto, uma atenção conjunta. Tem-se por foco descortinar o estudo empírico da norma jurídica para problemas reais no Distrito Federal que envolvam a segurança hídrica, saneamento básico e mineração, com a proposição de sugerir soluções na aplicação do direito diante dos principais problemas que compõem a interface entre empreendimentos hidro intensivos de mineração e a aplicação e formulação dos instrumentos da gestão hídrica. Especificamente, a proposta aborda a interface entre a legislação ambiental e mineral com a proteção dos recursos hídricos e a necessidade de racionalização do acesso e da distribuição de água perante os instrumentos da Política Nacional de Recursos Hídricos. Envolve revisão de literatura, sistematização de dados, proposição de instrumentos jurídicos de aperfeiçoamento e adaptação, além de análise da interpretação judicial sobre os temas.
