So you have received a letter of demand from ParkPay? This website explains your rights with regards to payment demands from ParkPay

ParkPay run a private car park company in Queensland. Many of their car parks do not have pay and display tickets and they simply "fine" you if you exceed a certain amount of time. I have also received complaints from drivers that the signs are not clear.

Interestingly, I have been contacted by a Queensland person who contacted the Queensland Department of Transport and Main Roads which maintains the state's vehicle registation system called "TRAILS". This person was advised by the department that the department is authorised under state legislation to hand out the names and addresses of vehicle owners to private parking companies such as ParkPay without having to obtain a court order. In other states of Australia private parking companies need to apply to the courts to obtain a court order in order to obtain the details of vehicle owners.

On the "Objections" page of the ParkPay website, it says " In the event that the car is registered in your name but was not driven by you but by someone else we recommend the simplest way to resolve this situation is for you to pay the fee and get reimbursed for the parking fee by the actual driver". This is very dodgy of ParkPay to say the easiest way to resolve the issue is by the owner of the car paying the fine. Of course, it is easier for Park Pay if you do this, but it is not easier for you. The easiest thing for you to do if you were not the driver, is to ignore any fine that ParkPay sends to you. It is also dodgy for a company to say or imply that someone other than the person who owns the debt should pay it. Why should the owner pay it if the debt belongs to someone else?

Don't be mistaken into thinking you are taking on a large corporation when you are dealing with Parkpay. Paypay is a tiny company owned by Colin Farquhar and Sharon Farquhar who run the company "office" from their home at 28 Rupert St, Windsor Queensland. If you search for Colin Farquhar in the White Pages, you will notice that his home phone number shown in the White Pages is also his company's fax number shown on Parkpay's letterheads.
