ACM Group

ACM Group have been found by the Federal Court of Australia to have engaged in illegal conduct in the attempted collection of debts from consumers. In behaviour that is somewhat similar to that engaged in by Car Park companies, ACM Group harassed and intimidated consumers and threatened them with legal action ACM Group was never likely to take. The Court found this behaviour to be misleading and deceptive conduct as well as undue harassment. The court imposed injunctions on ACM Group to not engage in this behaviour again. If they do engage in such behaviour again they can be found in contempt of court and can face criminal charges evem a jail term.

The Federal Court has also released audio recordings of phone calls in which debt collection agency ACM Group blackmailed people into repaying debts.

In the judgment the Court found that ACM Group's "misleading and deceptive conduct was widespread". ASIC Commissioner said that regarding the ACM Group case that "ASIC was committed to ensuring debt collectors operate professionally, and that consumers can be confident they will be dealt with fairly and lawfully.". The Federal Court declared that declarations of misconduct and injunctive relief be granged, restraining ACM Group from future similar conduct.
