So you have received a letter of demand from Car Park Compliance Services Pty Ltd eh?

Car Park Compliance Services also use the same debt collectors and lawyers as Parking Patrols Pty Ltd to send you out demands. But fear not. If you do not tell them who was driving, they have no way of finding out. Under contract law, private parking companies can only hold the driver liable for a private parking notice. If the notice is not paid, Car Park Compliance Services will apply to the courts to find the name and address of the vehicle owner. Car Park Compliance Service will then send a letter of demand to the owner, in the hope that the owner will either pay it, or give away the name of the driver, or perhaps admit they themselves were the driver.

On the attached PDF, you will see a side by side comparison of the Parking Patrols (Vic) Pty Ltd infringement notice and the Car Parking Compliance Services Pty Ltd notice. On the top is the CPCS ticket and on the bottom is the PP ticket. You can see they are almost identical bar the company names. For those of you that don't know about the strife Parking Patrols got into in 2012, you can read this link about them.

Getting your dispute past the admin staff

As mentioned, your appeal to Car Park Compliance Services Pty Ltd is unlikely be successful. In fact, they may not even read your appeal. You will likley get a generic reply from them saying "Thank you for your letter regarding the above notice. It is the responsibility of the vehicle operator to observe the parking sigs and the Contractual Terms and Conditions of us. Failure to comply with these conditions is a breach of the Contractual terms and Conditions that apply to the car park and therefore the existing notice stands".

If you have already appealed by phone, email or in writing, and got nowhere and now want to dispute your notice further, then proceed as follows.

Firstly, email William Jarman on williamfjarman@gmail.com and cc. william.jarmin@i.net.au If you get no reply within 3 business days, or an insufficient response, then you need to call James English who is the owner of Ace Parking, which runs the parking company where you were originally fined. Mr English's direct number is 0412-836-612. He usually answers his phone himself, so just ask "is that James?". Note though that if he is in a meeting, or driving, then his number will go through to another member of staff at Ace Parking. So if they say "no, can we take message and James will call you back" you can either leave your name and number or just try again a couple of hours later. When you finally get onto James, and tell him you are calling about a parking fine you got at an Ace Parking car park, he will try and tell you that the fine was not issued by Ace Parking and that you need to ring "Car Park Compliance Services" and that their phone number is on the fine. To this you respond "no, I've already contacted them and I only got a proforma response". James will then try and tell you its not his problem and that he (James) is from Ace Parking, not CarPark Compliance Services. To which you reply "Car Park Compliance Services act as agents for Ace Parking, therefore Ace Parking is the principal and I am entitled to complain to you". You need to be persistent, but eventually he will ask you what happened and what you might want to do about it. Let me be perfectly clear here: Car Park Compliance Services act as agents for Ace Parking. James English is the 50% owner and director of Ace Parking. He has the authority to tell Car Park Compliance Services to withdraw your fine and he often does so. Be persistent and don't give up. From reports I've had, James is quite a friendly guy and he won't be rude to you, as he knows you are a customer of Ace Parking. If he is busy, ask when you can call him back. Complaining to the authorities

If you have sent a notice of dispute denying liability for the fine to Carpark Compliance Services and asked them not to contact you again, then if they persist in sending you demands, you can make a complaint to Consumer Affairs Victoria. 1. You asked CPCS to stop sending demands and they kept sending them, allegedly breaching the Fair Trading Act.

2. You stated to CPCS that you weren't the driver, but they kept sending demands, allegedly breaching the Fair Trading Act.

Car Park Compliance Services is run by William Jarman who is their Company secretary and sole director. William Jarman also just happens to be the company secretary and sole director of Parking Patrols Pty Ltd. Parking Patrols Pty Ltd in 2012 were found by the Supreme Court of Victoria to have:- engaged in misleading and deceptive conduct in that it sent harassing and illegal letters to drivers to demand money.- issuing fake fines that mimicked council fines- illegally demand statutory declarations from vehicle owners to name the driver.- threatening legal action when they had not intention of carry it out such legal action.

Both Parking Patrols Pty Ltd and Car Park Compliance Services are in the business of placing payment notices on vehicle windscreens in Ace Parking car parks.

The way that both Car Park Compliance Services and Parking Patrols Pty Ltd both work is by encouraging you to appeal to them to have your fine waived. Then once they have your name and address they will send you a string of demands (at least 6 in total), each one 2 weeks apart. The demands will have different company names on them, but they will all originate from the same office.

Make no mistake, they will rarely waive your fine. It doesn't matter if you show them a photo of your car with your valid ticket on the dashboard. It doesn't matter if you show them a credit card statement proving that you paid for your parking. Once the Carpark Compliance Services' patrol person has placed the fine on the windscreen you have a problem.

You will get letters from debt collectors, and from lawyers, but those letters are all emanate from the same office. If you look at the "contact" page on their website, you will see it says:

But this isn't their office, this is nothing more than a mail forwarding service.
