A sharp motorist has beaten Secure Parking and Traffic Monitoring Services with a single blow by pointing out that Secure Parking were issuing illegal fines.

Dear TMS

I deny that Traffic Monitoring Services (TMS) is entitled to make the claim against me.

The Portside Wharf website (see attachment) states "One hour free parking – 1 hour limit. Fines will apply thereafter." As TMS nor Portside Wharf have the authority to issue fines this is "dodgy as".

The sign "displaying" the carpark terms and conditions has such small writing, it is not able to be read safely while driving a vehicle by a person with normal eyesight. Should a driver stop to read the sign, they would block the carpark entrance for at least 5 minutes. This would also be unsafe.

The position in which the vehicle was parked is at the edge of a fenced construction area. Any limit signs present are not immediately obvious or are behind the construction area fencing.

I respectfully ask that you withdraw your "Non-compliance breach notice" with no further claims.

Hi Simon,

Thank you for your email. Please be advised that TMS is hired by the centre management and the private land owners to enforce the terms and conditions of the car park, which are adequately displayed not only on all entrances, but also displayed all through out the premises.

Regardless, please be advised that this breach has been waived in full, however, should this situation arise again TMS will not be in a position to waive any further breaches to this registration.
