14. Should I apply to VCAT or the CTTT?

You can apply to VCAT (in victoria) or CTTT (in nsw) to:

1. Have a fine withdrawn ( see http://www.consumeraction.org.au/downloads/FS31Privatecarparkingfines210511.pdf and http://consumeraction.org.au/fines-from-private-car-parks/)

2, Have your money refunded if you've already paid the fine (see http://www.consumeraction.org.au/downloads/FS31Privatecarparkingfines210511.pdf )

3. Claim compensation if you've been harassed (see http://www.consumeraction.org.au/downloads/FS12Imbeinghassledbyadebtcollector-Dec10.pdf and http://www.consumeraction.org.au/downloads/FS12B-Debtcollection-seekingcompensation-VCAT-150311.pdf )

4. Have your case transferred to VCAT if proceedings are issued against you in a Victorian Magistrates Court.

If a private car park company brings proceedings against you in a Victorian Magistrates Court, you can apply to have the proceedings moved to VCAT. See the section titled "What should you do if proceedings are filed in the Magistrates Court against you?" in this document issued by the Consumer Action Law Centre: http://www.consumeraction.org.au/downloads/FS12B-Debtcollection-seekingcompensation-VCAT-150311.pdf

If your application for transfer is successful, the company will not be able to claim legal costs, or court costs, against you.

Note that whilst the above links describe the VCAT process, the CTTT process is almost identical.

For more information, you can call the http://www.cclcnsw.org.au/ (for NSW residents) or the http://www.consumeraction.org.au/ (for Victorian residents).

The CTTT form to make a claim on is here .
