ICM Partners make payment demands for Secure Parking and Traffic Monitoring Services.

I have the following problems with that paragraph. Firstly, ICM Partners say "you agreed to pay our client ....". That is, they are claiming the vehicle owner agreed to pay their client. But then ICMPartners say "if any other person was driving your vehicle.....". So on the one hand ICM Partners are saying that the vehicle owner agreed to certain terms and conditions, then in the next sentence they admit they have no idea who was driving. That is very dodgy. But the worst bit is the next sentence where they demand a statutory declaration. In Victoria, it is against the law to demand a statutory declaration from some one to prove they are not responsible for a debt.

"Pursuant to the clients terms and conditions of car park entry, you agreed to pay our client liquidated damages and any other loss resulting from the breach. If any other person was driving your vehicle with your authority at the time of the breach, please provide a statutory declaration indicating the full name, current address, and contact number of the driver at the time of the breach."

The letter from ICMPartners goes on to say:

This is dodgy because for ICM Partners to get a default listing against the vehicle owner, ICM Partners would firstly need to get a court judgement against the owner. And to do that, ICM Partners would need to serve court documents on the vehicle owner. So it would be impossible for ICMPartners to lawfully default list your credit file with further notice to you.

I have only seen one letter from ICM Partners Pty Ltd and it goes like this:"If your payment of the above amount is not received in our office within seven days, further action for the recovery of the debt may be instigated without further notice to you. This may include default listing your credit file and or other enforcement action."
