VA statement in support of claim 21-4138 form

If you decide to ask the VA for help in this matter be advised that I have taken this matter to the Veterans Board of Appeals (VBA) in Washington DC. The VA will require medical records, a physician letter with a statement (a "more likely than not" or " a least likely as not") and that a physician has read medical literature that links the fuels with your illness. Most physicians lack the expertise in linking chemical exposure to ailments. However, once they are given the supporting documentation from medical journals, CDC, ASTDR, or AGCIH documents they will recognize that there is the 50/50 likelihood your medical problem can be connected to your exposure to the missile fuels.

The Veterans Board of Appeals (VBA) will acknowledge that you were exposed to the fuels and that is all they will admit. The burden of proof that your ailment is due to fuel exposure is your responsibility. You can also ask that the VA Compensation and Pen division, or your VA physican to refer you to WRIISC. Submit an application to the WRIISC organization in your section of the US. there are three WRIISC facilities in the US. See the WRIISC topic under VA Claim Help.

Read the topic on Physician letters as that is your most effective course of action. If your claim has been been rejected/denied and you are in the appeal process have an attorney get involved. They know how to approach the VA and get your claim in order. It is your right to be represented after denial by the VA. Yes, you will pay 20% of the back award to the attorney but only if they win your case.
