William Glubbe late of Lamerton in the county aforesaid husbondman had been attached to answer John Pomeroy and Johanna his wife, Ellen Skynner and Thomasia Skynner, in a plea wherefore by force of arms he broke into a close of the said John and Johanna, Ellen and Thomasia at Lamerton, and depastured, trampled and consumed with avers their grass to the value of 100s there lately growing, broke down and laid low their fences there lately erected, to the value of 40s, and inflicted other enormities upon them, to grave damage of the said John and Johanna, Ellen and Thomasia, and against the peace of the lord now king &c.; and wherein the same John and Johanna, Ellen and Thomasia, by Roger Elford their attorney, complain that the aforesaid William on the 10th day of January in the 6th year of the reign of the lord now king, by force of arms, to wit with swords, sticks and knives, broke into a close of the said John and Johanna, Ellen and Thomasia at Lamerton and depastured, trampled and consumed with avers, to wit with horses, oxen, cows and sheep, their grass there lately growing, to the value &c. and broke down and laid low their fences there lately erected, to the value &c., continuing the trespass aforesaid, as to the depasture, trampling and consumption of grass aforesaid from the aforesaid 10th day of January up to the date of the impetration of the original writ of the said John and Johanna, Ellen and Thomasia, namely the 27th day of September in the 7th year of the reign of the lord now king, on divers days and occasions, and other enormities &c. to grave damage &c. and against the peace &c. whereby they say that they are injured and have damage to the value of £10; and therein bring their suit &c.

And the aforesaid William comes by John Ford his attorney, and defends the force and injury when &c.; and as to the coming with force and arms, he is in no way guilty thereof, and of this puts himself upon the country; and the aforesaid John and Johanna, Ellen and Thomasia likewise; and as to the rest of the trespass aforesaid supposed above to have been made, the same William says that the aforesaid John and Johanna, Ellen and Thomasia should not have their action against him, for he says that the close aforesaid as well as the places in which the trespass aforesaid is supposed to have taken place are, and were at the time aforesaid that the trespass aforesaid is supposed to have taken place, 8 acres of (arable) land and 2 acres of meadow with appurtenances in Bromepark in Lamerton aforesaid are, and were at the time that the aforesaid trespass is supposed to have happened, the soil and freehold of the aforesaid William, wherefore the same William at the said time at which &c. broke into the close aforesaid as his own soil and freehold of the said William, and he depastured, trampled and consumed with the avers aforesaid the grass aforesaid to the value &c. there lately growing as his own grass growing upon the said 8 acres of land and 2 acres of meadow as upon his own soil and freehold, and he broke down and laid low the aforesaid fences then lately erected as he had good right; and this he is ready to prove; wherefore he craves judgment whether the aforesaid John and Johanna, Ellen and Thomasia should have their action aforesaid against him &c.

And the aforesaid John and Johanna, Ellen and Thomasia say that they should not be precluded from having their action aforesaid by anything alleged above, because they say that the aforesaid 8 acres of land and 2 acres of meadow with appurtenances are and at the time of the trespass aforesaid having been made were the soil and freehold of the same John and Johanna, Ellen and Thomasia and not the soil and freehold of the aforesaid William as the aforesaid William has alleged above; and they crave that this be inquired by the country; and the aforesaid William likewise; therefore it is ordered the sheriff to cause to come here three weeks from Easter twelve &c. by whom &c. and who neither &c. to recognize &c. that both &c.

Research Notes:

Lamerton. Richard Pomerey and Elizabeth Densell leased for life the demesne etc. of the manor of Lamerton to John and Walter Burges. John Burges daughter Joanna was mother of John Gyll; who surrendered lease to Bartholomew Fortescue in 1518.

1515-1518:

C 1/412/25 John Gyll, son of Johan, daughter of John Burges. v. Walter Burges, brother of the said John Burges.: Surrender to Bartholomew Fortescue, esquire, tenant in reversion, of a lease for life, made to both parties by Richard Pomerey, knight, and Elizabeth, his wife, of two closes, parcel of the demesne of the manor of Lamerton.

Lamerton came from Fortescue.

At the same time:

In 1516 John Pomeroy and his wife Joanne and two SKYNNER women were in a dispute with William Glubbe regarding use and income of lands in Lamerton.

Going back one generation to the father of Sir Richard; to Henry Pomeroy, esq: Henry had a son John Pomeroy, youngest brother of Sir Richard, who was born circa 1445.

AP feels that the John Pomeroy son of Henry Pomeroy, esq. is the John Pomeroy who married the daughter of Strode:

The dates tell us that the John Pomeroy who m. daughter of Strowd/Strode could be the very same John Pomeroy who m. Joanna and was in dispute over Lamerton property in 1516.

We can’t attach the Lamerton property to any other branch of the Pomeroy family.

Note.Two generations later:

John Pomeroy M. Joanna Cottell: 1570:: Son Peter Pomeroy and Lowdaye Davyes: 1599: Granddaughter Elizabeth: m John Bealey: 1628 (Lamerton leases involved.)

This family was said to be connected to the Tregony Pomeroys.
