This indenture Tripartite made the ninth day of May in the twelfth Year of

the Reign of our Sovereign Lord george the Third by the Grace of God of Great Britain France and

Ireland King Defender of the Faith and so forth and in the Year of our Lord Christ one thousand seven hundred and Seventy Two

Between John Pomeroy of the Borough of Bodmyn in the County of Cornwall Gentleman

(Eldest Son now Surviving and also

Heir at Law of John Pomeroy of the Borough of Fowey in the County aforesaid Gentleman his late Father deceased and also the next

Brother and Heir at Law of Joseph Pomeroy of Fowey aforesaid Gentleman also deceased who was the Eldest Son and Heir at Law of the said

John Pomeroy deceased at the Time of his Death) of the First Part,

Sarah Hartle (Hearle?) of the Borough of Tregony in the County aforesaid Widow lately

called Sarah Pomeroy (Administratrix of the Goods and Chattels Rights and Credits Unadministered of the said John Pomeroy deceased

with his Will annexed and also Administratrix of the Goods and Chattels Rights and Credits of the said Joseph Pomeroy who dyed Intestate)

Hannah Tredwen of the Parish of St Mabyn in the County aforesaid

Widow Elizabeth Pomeroy of Bodmyn aforesaid Spinster and

Edward Pomeroy of Bodmyn aforesaid Gentleman (which said John Pomeroy Sarah Hearle Hannah Trednen Elizabeth Pomeroy and Elizabeth Pomeroy together

with the said Joseph Pomeroy and Mary Pomeroy who dyed a Minor Unmarried and Itestate in the Life Time of the said Joseph Pomeroy are the only

Children of the said Mary Pomeroy deceased who were living at the Time of his Death) of the Second Part and Ralph Cole of the Parish of Withiel in the County

aforesaid Gentleman of the Third Part Whereas by Indenture of Lease and Release bearing Date respectively the Eleventh and Twelfth Days of

February in the Year of our Lord One Thousand Seven Hundred and Seventy Three and made or mentioned to be made between William Cole of

Penwine in the Parish of Saint Mabyn aforesaid Gentleman of the One Part and the said John Pomeroy since deceased of the other part The said

William Cole and in Consideration of the Sum of Four Hundred Eighty Six Pounds of Lawful Money of Great Britain to him in hand paid by the said

John Pomeroy deceased Did Grant release Alien Infeosse Remise Quit Claim for ever Bargain and Sell unto him the said John Pomeroy (in his actual

Possession and Seizin then being by Virtue of the said Indenture of Lease and of the Statute for transferring Uses into Possession) and to his Heirs and

Hereditaments whatsoever to the said Messuage Lands Tenements and Premises belonging or in anywise appertaining or held used occupied or injoyed

as Part Parcel or Member thereof And All and singular those Messuage Lands Tenements Hereditaments and Premises with all and singular the

Appurtenances as were or were reputed esteemed deemed or taken to be part or Parcel of or belonging unto the beforementioned Messuage Lands Tenements

Hereditaments and Premises in or called Penwine aforesaid which were situate lying and being in the Parish of Saint Tudy in the said County of Cornwall

and then in the Tenure Holding or Occupation of him the said William Cole his Assignee or Assigns Tenant or Under Tenants And the Reversion and

Reversions Remainder and Remainders Rents Dutys Suits and Services thereof and of every Part and Parcel thereof And all the Estate Right Title

Interest Claim and Demand whatsoever both in Law and Equity of him the said William Cole of in or unto the said Messuage Lands Tenements

Hereditaments and Premises with all and singular the Appurtenances in or called Penwine aforesaid To have and to hold all and singular

the said Messuage Lands Tenements Hereditaments and Premises and every Part and Parcel thereof with all and singular the Appurtenances in or

called Penwine aforesaid as well such Parks thereof as were situate lying and being in the said Parish of Saint Mabyn as such other Parts thereof as were

situate lying and being in the beforementioned Parish of Saint Tudy unto the said John Pomeroy his Heirs and Assigns for ever To the only Use and

Behoof of the said John Pomeroy his Heirs and Assigns for evermore Subject nevertheless to a Proviso contained in the said Indenture of Release

for making void the same if the said William Cole his Heirs Executors Administrators or Assigns should well and truly pay or cause to be paid to the

said John Pomeroy his Heirs and Assigns the Sum of Four Hundred Eighty Six Pounds on the Twenty Fifth Day of October then next ensuing the Date

thereof And whereas the said Sum of Four Hundred Eighty Six Pounds or any Part thereof was not paid according to the aforesaid Proviso for

that Purpose whereby the Estate of the said John Pomeroy deceased of and in the said Premises did in law become Absolutely And whereas the said

John Pomeroy departed this Life some Time in or about the Year One thousand seven hundred and Thirty two leaving the said the said Joseph Pomeroy the Eldest

Son and Heir at Law And he the said John Pomeroy in his Life Time duely made and executed his last Will and Testament in Writing bearing Date on or

about the Third Day of July in the said Year One Thousand Seven hundred and Thirty Two and did hereby Governance promise all the Residue of his

estate both real and personal after Payment of his Debts Legacys and Funeral Expenses unto his said son Joseph Pomeroy and appointed hi sole

Executor of his said Will and the said Joseph Pomeroy being then an Infant he the said John Pomeroy did by his said Wife appoint Philip Rashleigh Esquire

Peter Goodall Esquire Jane Rashleigh Spinster and his said Testator’s Wife Joan Pomeroy (during here Widowhood only) and also Joseph Pomeroy the said

Testator’s Brother to be Guardians over his said Sons and Executor the said Joseph Pomeroy and also over all his other Children who were all then Infants

and directed That in order to save Trouble to the said Guardians and Trustees, his said Wife should receive and pay all Moneys relating to his

Estate and Effects And whereas soon after the Death of the said John Pomeroy the said Joan Pomeroy his Widow obtained Letters of

Administration of his personal Estate and Effects to be granted to her by the proper Ecclesiastical Court (with his said Will annexed) during the

Minority of the said Joseph Pomeroy the Executor and she and the said Joseph Pomeroy the Brother of the said Testator acted as Guardians and

Trustees for the said Testator’s Children but the said Philip Rashleigh Peter Goodall and Jane Rashleigh declined acting therein And whereas

whereas by a Deed or Indenture Tripartite bearing Date the Twenty Ninth day of September in the Year of our Lord One thousand

Seven Hundred and Thirty Nine and made or mentioned to be made between the said William Cole of the first part the said John

Pomeroy Son of the said John Pomeroy deceased of the Second Part and the said John Pomeroy and Joan Pomeroy the Trustees of the Third Part after a Recital

of the said Mortgage and of several Accounts having been adjusted and passed between the said William Cole and the said John Pomeroy deceased in his Life Time

therewith and whereupon there appeared to be fully due for Principal Interest and other Moneys advanced the Sum of Nine Hundred & Thirty Six Pounds lawful

British Money The said William Cole in consideration of the said Sum of Nine Hundred and Thirty Six Pounds so due and of the further sum of Sixty Four

Did for himself his Heirs and Assigns for ever Give Grant Alien Sell Release Quit Dain Ratify Convey and Confirm unto the said Joseph Pomeroy the Younger

in his full quiet and peaceable Possession Seizin being and to his Heirs and Assigns for ever All the Estate Right Title Interest Equity of redemption Claim

at any Time or Times thereafter either in Law or Equity ask claim or demand to have any Manner of Estate Right Title Interest or Demand of in unto or out of

the said Messuage Lands Tenements Hereditaments and Premises thereby granted and confirmed or any Part and Parcel thereof but that he and they should be

thereof and from all Action Estate Right Title Interest Claim and Demand whatsoever of in & to the said several Premises and every & any Part thereof for every both

in Law and Equity from henceforth foreclosed excluded and utterly debarred And the said William Cole did thereby for himself his Heirs and Assigns

Confirm the Estate Right and Title of the said Joseph Pomeroy the Younger and his Heirs & Assigns of in & unto these Messuage Lands Tenements Hereditaments

have and to hold all and singular the thereinbefore mentioned Messuage Lands Tenements Hereditaments & Premises with all & singular the Appurtenances in or called

Penwine situate & lying in Saint Mabyn & Saint Tudy aforesaid & every Part & Parcel thereof with the Appurtenances unto the said Joseph Pomeroy the Younger his Heirs & Assigns for Ever

Absolutely without any Condition whatsoever To the sale only and proper Use & Behoof of the said Joseph Pomeroy the Younger his Heirs & Assigns for Evermore And whereas

the said Joseph Pomeroy the Son & Executor of the said John Pomeroy the Testator having obtained his Age of Seventeen Years did on or about the Fourteenth Day of April One thousand seven hundred

and forty Three duely prove the Will of the said John Pomeroy the Testator & undertook the Execution thereof And whereas the said Joseph Pomeroy the Son dyed in or about the

of Administration of his personal Estate & effects to be granted unto her by proper Ecclesiastical Court And also Letters of Administration of the personal Estate and Effects of the

said John Pomeroy the Testator left Unadministered by the said Joan Pomeroy Mother & Joseph Pomeroy her Brother with the Will of the said John Pomeroy the Testator and

As in & by the said several Deeds or Indentures & the said Will and Letters of Administration Relation being unto them respectively had may more fully appear And

whereas the said Ralph Cole hath contracted & agreed with the said John Pomeroy Party to these Presents for the absolute Purchase of the said Messuage Lands

Tenements Hereditaments & Premises for the Sum or Price of One Thousand Three Hundred & Fifty Pounds now this Indenture witnesseth that for and in

Consideration of the said Sum of One Thousand Three Hundred & Fifty Pounds of Lawful Money of Great Britain to the said John Pomeroy Party to these Presents in Hand will

and truly paid by the said Ralph Cole at or before the Execution of these Presents at the Request & by the Direction and Appointment of the said Sarah Hearle and also by the

Approbation and Consent of the said Hannah Tredwen Elizabeth Pomeroy & Edward Pomeroy (testified by their severally being Party to & their Seal & Delivery of these Presents) the Receipt

whereof the said John Pomeroy Party to thee Presents doth hereby acknowledge & thereof & of every Part & Parcel thereof doth acquit release and discharge the said Ralph Cole his Heirs Executors and

Administrators and every of them for ever by these Presents & in Consideration of Five Shillings Apiece of like lawful money to them the said Sarah Hearle Hannah Tredwen Elizabeth Pomeroy

and Edward Pomeroy in Hand also paid by the said Ralph Cole at or before the Execution of these Presents the Receipt whereof they do hereby severally & respectively acknowledge He

the said John Pomeroy Party to these Presents hath Granted Bargained Sold Aliened Released and Conveyed And They the said Sarah Hearle Hannah Tredwen Elizabeth Pomeroy

and Edward Pomeroy have & every & each of them hath Remised Ratified & Confirmed And by these Presents he the said John Pomeroy Party to these Presents Doth Grant

Bargain Alien Release & Convey And they the said Sarah Hearle Hannah Tredwen Elizabeth Pomeroy and Edward Pomeroy Do & every & each of the Doth Remise Ratify & Confirm

unto the said Ralph Cole (in his actual Possession now being by Virtue of a Bargain and Sale to him thereof made by the said John Pomeroy Party to these Presents Sarah Hearle

Hannah Tredwen Elizabeth Pomeroy and Edward Pomeroy for the Term of one whole Year by an Indenture bearing Date the Day next before the Day of the Date of these Presents and by

Force of the Stature for transferring Uses into Possession & to his Heirs & Assigns for ever All & singular those the aforesaid Messuage Lands Tenements Hereditaments and Premises

with all & singular the Appurtenances in or called Penwine Situate lying & being in the said Parish of Saint Mabyn Together with all Houses Edifices Buildings Barns Orchards Gardens

Use Intent or Purpose whatsoever To be held of the High & Chief Lord & Lords of the Fee & Fees of the Premises by the Rents & Services thereof antiently due & of Right accustomed

And the said John Pomeroy Party to these Presents Sarah Hearle Hannah Tredwen Elizabeth Pomeroy Edward Pomeroy do hereby severally and respectively for themselves

& for their several & respective Heirs Executors & Administrators covenant promise grant agree to & with the said Ralph Cole his Heirs & Assigns in Manner following (that is to say)

That for & notwithstanding any Act Matter or Thing whatsoever done by them the said John Pomeroy Party to these Presents Sarah Hearle Hannah Tredwen Elizabeth Pomeroy Edward

Pomeroy or the said John Pomeroy their deceased Father of the said Joseph Pomeroy their deceased Brother or any or either of them to the Contrary they the said John Pomeroy Party to these Presents

Sarah Hearle Hannah Tredwen Elizabeth Pomeroy & Edward Pomeroy or some or one of them now are or is lawfully rightfully & absolutely seized of & in all singular the said Messuage

Lands Tenements Hereditaments & Premises hereby or mentioned or intended to be hereby granted & released with the Appurtenances of a good sure perfect lawful absolute & indefeasible

Estate of Inheritance in Fee Simple without any Condition Use Trust Power of Revocation or other Matter or Thing whatsoever to alter change charge revoke determine or make void the

same And that for & not withstanding any such Act Matter or Thing as aforesaid they the said John Pomeroy Party to these Presents Sarah Hearle Hannah Tredwen Elizabeth

Pomeroy and Edward Pomeroy some or one of them now have or hath in themselves some or one of htem goods Rightfull Power and lawful and absolute Authority to

grant convey & assure the same and every Part and Parcel thereof with the Appurtenances unto and to the Use of the said Ralph Cole his Heirs and Assigns in Manner

aforesaid and according to the true Intent and Meaning of these Presents And also that he the said Ralph Cole his Heirs and Assigns shall or lawfully may from Time

to Time & at all Times hereafter peaceably and quietly have hold use occupy possess and injoy the said Messuage Lands Tenements Hereditaments and Premises hereby or mentioned

or intended to be hereby granted released confirmed and every Part and Parcel thereof with all and singular the Appurtenances and receive and take the Rents Issues and Profits thereof

and of every Part and Parcel thereof to and for his and their own proper Use and benefit without the lawful Set Suit Trouble Molestation Interruption Hinderance or Denyal of them

the said John Pomeroy Party to these Presents Sarah Hearle Hannah Tredwen Elizabeth Pomeroy & Edward Pomeroy or any or either of them or of any Person or Persons claiming or to

claim any Estate Right Title Trust or Interest either in Law or Equity of in to or out of the said Premises or any Part or Parcel thereof by from or under or in Trust for them any or either

of them, or by from or under their said deceased Father and Brother or either of them And further that they the said John Pomeroy Party to these Presents Sarah

Hearle Hannah Tredwen Elizabeth Pomeroy and Edward Pomeroy and every and either of them and their every and either of their Heirs and all and every other Person and

Persons having or lawfully claiming or which shall or may have or lawfully claim any Estate Right Title or Interest of in to or out of the Premises hereby or mentioned

or intended to be hereby granted released and confirmed or of in to or out of any Part or Parcel thereof by from or under them any or either of them or by from or under their

said deceased Father and Brother or either of them shall and will from time to Time and at all Times within the Space of Fifteen years next ensuring the Date of these

Presents upon the reasonable Request and at the proper Costs and Charges of the said Ralph Cole his Heirs and Assigns make do acknowledge levy execute and suffer all and every

such further and other lawful and reasonable Act and Acts Thing and Things Device and Devices Assurance and Assurances in the Law whatsoever for the further better and

more perfect Assuring and Conveying the said Messuage Lands Tenements Hereditaments and Premises hereby or mentioned or intended to be hereby granted released

and confirmed and every or any Part or Parcel thereof with the Appurtenances unto the said Ralph Cole his Heirs and Assigns for ever Be it by Fine or Fines

Common Recovery or Recoverys Deed or Deeds instructed (faded) inrolled the Inrolment of these Presents Release or confirmation of by all or any the said Ways or

Means or by any other Ways or Means in the Law (faded) as by the said Ralph Cole his Heirs or Assigns or his or their Counsel in the Law shall be

reasonably devised advised or required So as the Part or Parcel be required to make such further Assurance or Assurances be no compelled or compellable for the making

or doing thereof to go or travel from the Place of his home (faded) Abode at the Time of such Request to be made And it is hereby Agreed and Declared by and

between the said John Pomeroy Party to these Presents Sarah Hearle Hannah Tredwen Elizabeth Pomeroy and Edward Pomeroy and the said Ralph Cole That all and every such further

and other Assurance & Assurances which shall or may at any Time or Times hereafter be made levied suffered or executed of the said Premises hereby or mentioned or intended to be hereby

granted released and confirmed or any Part or Parts Parcel or Parcels thereof shall be and enure and shall be adjudged deemed & taken to be and enure to the only proper use and Behoof

of the said Ralph Cole his Heirs and Assigns for ever and to and for no other Use Intent or Purpose whatsoever In witness whereof the abovesaid Parties to these

Presents being written or ingrossed on Three Skins or Pieces of parchment each duely stamped their Hands and Seals Interchangeably have set the day and
