I've been writing on the web for more than 15 years and in that time I've had lots of discussions about copyright. All of my work is still copyrighted, and protected, but I am starting to consider that there are many other options out here, and that focusing on protecting copyright isn't always the right decision. In fact, in many cases allowing people to copy your work can result in more sales , more page views, more fans, and more money!!!

Dear student:
As required by the Higher Education Opportunity Act, Community College of Vermont and other colleges are required to provide all enrolled students with information about the liabilities and issues associated with illegal file sharing and the unauthorized distribution of copyrighted material by users of the college's network.
1. Unauthorized distribution of copyrighted material, including unauthorized peer-to-peer file sharing, is illegal and may subject students to civil and criminal liability.
2. Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-sharing context, downloading or uploading substantial parts of a copyrighted work without authority constitutes an infringement.
Penalties for copyright infringement include civil and criminal penalties. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or "statutory" damages affixed at not less than $750 and not more than $30,000 per work infringed. For "willful" infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorneys' fees. For details, see Title 17, United States Code, Sections 504, 505.
Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense.

3. VSC policies that address unauthorized peer-to-peer file sharing, including disciplinary action that may be taken, include:
• The VSC Policy 502, VSC Computing And Telecommunications Technology Conditions Of Use Policy - http://www.vsc.edu/about-vsc/VSC_Policies/Policy%20502%20Computing%20and%20Telecommunications%20Technology%20Conditions%20of%20Use.pdf, which states that “Violations of this Policy by students may lead to loss of VSC net privileges and/or discipline up to and including dismissal.” Additionally, “Students and employees who engage in activity related to copyright infringement may be liable for civil and/or criminal penalties.”
• The VSC Policy 416 on the Use and Ownership of Copyrighted Materials - http://www.vsc.edu/about-vsc/VSC_Policies/Policy%20416%20Use%20and%20Ownership%20of%20Copyrighted%20Materials.pdf establishes standards regarding the use of copyrighted materials and states that “it is the intent of VSC to comply at all times with the United States Copyright Laws.”
• Additionally, any Digital Millennium Copyright Act (DMCA) notices are responded to within one working day and include removal of Internet privileges on the offending computer until the issue is resolved. Each college requires that the offending material be removed and may require that the computer be cleaned and rebuilt.

Our Democracy - is the voice of the people. When things are open to everyone, there are many eyes to scrutinize.
When only a few have information, only a few have power, corruption happens and things stagnate.
When you hold your failures in secret, no one else can learn from them, it takes longer to create new & improve.
I believe in Open Source - more has been accomplished - because the web & software are free - we have created more and grown faster than ever on earth.
When companies patients their products - it freezes others from learning, creating & making advancements. Yes Yes - it protects a company investments ... but do we really need to protect companies? and if so for 20 years??
The music industry thought that if they fought for their exclusive rights - that it would protect them & the artists, instead it created a barrier and the younger generation distributed their own music in their own way.
The insurance companies convinced us in the past 35 years - that if "others" knew a persons medical condition that no one would insure them...Even though we the people - were paying for the insurance ... The insurance companies have created such a mockery of secrecy with HIPPA - that to get a persons entire medical history is all but impossible, to use their generic makeup to determine their medial direction is impossible to study on a large basic - because it might impact someones privacy ... When you are sick you don't care about privacy ... you only want the complete set of tools to help you live your best life.
We concentrate on privacy/secrecy to give a few power, instead of give everyone information to grow our world. A world were we all collaborate and advance.

I believe in the way Google has given us the World in Maps, Free Software & Systems and they have given us our data back and tools to explore it.
Do I worry - yes. I want to be the one to spend my money, and authorize my purchases. For this I do need laws to protect my rights to have access to any information about me, and the rights to make sure the data is correct.

a) I don't like secrets - Secrets give power to those who command secrecy
b) I'm a Hippy - Power to the People
c) We never had privacy - growing up everyone knew each others children, Teachers, Secretaries, Church, Shopkeepers they all kept track of each others kids, you might get away with something for a week - but very rarely.
2. Mathematics Background
a) I wanted to become an actuary
b) I love the Mathematics of Insurance
c) In my son's lifetime I have seen what Insurance Companies have convinced us of.
3. View of Google
a) Google has enabled a level playing field
b) Google believes the data belongs to the People
c) Google is developing tools to use with Big Data
and what about Facial Recognition.
I have identical nephews
And they dress alike and wear their hair alike
they know most people can't tell them apart
Even their family - if we don't take that extra second
are not 100% sure.
They even stand perfectly still - knowing I'm watching for something that tells me which one is which.
Facebook has ID'ed them correctly 99% of the time
Only once when it was just one of them - they got it wrong.
But it has been years ... since that one error.

I grew up in an era where everyone in my small town had eyes on every kid. They watch, kept track of, and called your mother if they saw you doing anything out of line, and my mother did the same for her friend's kids. Since everyone knew everyone in town - you knew if you did anything wrong - your Mother would hear about it, and Jil would get grounded. I spent 80% of my Freshman & 1/2 my Sophmore years in High School grounded ... until I finally got it ... they would find out what I was up to no matter what - so I just might as well follow the rules if I ever wanted any freedom!
I did NOT grow up with privacy - and if you did - Santa, The Easter Bunny & God COULD see everything you did, thought, or thought you got away with.
Every store you went in you were monitored from the time the bell rang when you walked in until the bell rang when you walked out.
When the internet came along (by then I had 15 years of computers, 10 years of networking ) I knew everything we did was being logged somewhere.
When I told the kids no computers after 8 pm, I would check the temp files time/date stamp to see if they had not followed the rule - they found out early ... every web page & image you download is stored in your temp files folder. Their mom/stepmom was watching.
I am always surprised when students are shocked about privacy, since I didn't grow up with any, didn't expect my kids to have any, why would anyone using a computer for ANYTHING think they had privacy?? My Mother was one of 9 children - there was no privacy in a small house with 1 bathroom and 11 people, plus Aunts, Uncles & cousins visiting constantly. My Father lived in the City in apartments with thin walls, there was no privacy. I'm not sure when the privacy idea started??
Rich people have Big Houses with big lawns between houses, fences, gates, etc. They could hire private detectives to research other people, poor people didn't have those resources. But rich people have servants, cleaning people, pool cleaners, lawn care, garbage collection, etc. And we know from books like The Help and Diana Story that those people can tell your story.
I have felt that privacy was an illusion, some families are raised to think it is a right, other families are taught it is a myth - and so you had better do the right thing all the time, it will be easier in the long run.
WE now have DNA testing, and use it to help solve medical issues. Medical History and making that accessible to your Doctors or Crowd Sourcing will no longer be thought of as private, because if you get sick, really sick you will have to share your data. When someone is sick in a small town - everyone knows it. There are volunteers that help do the work, volunteers to bring dinners to the family, Fundraisers to help the family in the form of Church Dinners - everyone who comes to the dinner knows this money is going for a good cause, Community activities to help raise awareness. Ex. Runs, Walks, Marathons - where the participants were t-shirts with Names & Faces of those that are battling or have lost a battle with the illness.
When you are born - your birth is public and added to a census town, state, nation. When you enter school, graduate, marry, divorce, have children, etc. etc are all public records, any violation after you are 18 is public record. Once you are dead - your Death Certificate is public knowledge - it lists the cause of death, parents names, spouse name, etc. Your life is now an open book. So anyone who knows the deceased family - knows there is Cancer, suicide, etc in the family history - that is not private.
Is knowing how much information has been available new?? or just ignorance about data?
It's just a more level playing field. You no longer have to be rich to access data, and Google gives you access to their data, they provide tools (many free) to access the data and summarize it. Others would have hoarded it and charged heavily for access - where Google gives them away and says ... take this data and make information out of it - create new products, new companies, new industries!
