There is no delivery of possession at the time of entering into agreement to sell - Hence, the agreement to sell was not required to be registered -Transfer of Property Act, 1882 (4 of 1882) Section 53-A.
Registration Act, 1908 (16 of 1908) Section 17(1-A) (as inserted by Act 48 of 2008) – Amendment is only for the purpose of Section 53-A of the Transfer of Property Act, 1882.
