TRESA introduced a schedule A to be attached with the Listing agreements, in this schedule, you are supposed to include the list of services. You will be providing to your clients as well as other details surrounding multiple representations, and or termination
Please use the below as a guide and make sure you read everything before you include it in an agreement, what you include as a commitment from you to your client so please do not just copy and paste
The Parties hereby enter into this Listing Agreement to outline the services provided by the real estate agent in connection with selling a property. The scope of services includes, but is not limited to, the following:
The agent will assess the property's value, analyze market trends, and recommend an optimal listing price.
Recommendations on how to enhance the property's appeal, including staging, repairs, and improvements.
Development of a customized marketing plan to attract potential buyers, including online listings, professional photography, and virtual tours.
Creation of a compelling property listing with accurate details, high-quality images, and engaging descriptions.
Coordination and hosting of property showings for potential buyers.
Negotiation of offers to achieve the best terms, price, and results for the seller.
Regular updates on market activity, feedback from showings, and adjustments to the marketing strategy if needed.
Assistance with paperwork, including the Agreement of Purchase and Sale, disclosures, and other necessary documents.
Facilitation of the closing process, including communication with lawyers, lenders, and other parties involved.
Recommendations for reliable service providers (e.g., inspectors, contractors, movers, lawyers..etc) as needed.
Should the seller wish to cancel this agreement, the agent agrees to cancel this listing agreement, and obtain a cancellation signed by his / her respective manager within 24 hours of the seller's request
The Parties acknowledge that services may be adjusted, modified, or omitted based on individual circumstances, market conditions, and evolving seller needs. The agent's goal is to maximize the property's value and ensure a smooth transaction.
If the seller and Agent agree to amend the contents of this schedule, any changes will be promptly communicated and mutually agreed upon in writing.
In a case of designated representation agreement, the Seller receives written notice of a multiple representation situation to which the Seller does not provide their consent to participate, the Seller agrees that the Brokerage reserves the right to appoint an alternate designated representative, mutually agreeable to the Parties, from within the Brokerage to assume the responsibilities agreed to within this Representation Agreement.
The parties further acknowledge and agree that, while every effort will be made to deliver comprehensive and professional services, the nature and extent of services may adjusted, modified or omitted based on individual circumstances, market conditions and evolving needs of the Seller. Should any of the above noted services not be required during the course of this Representation Agreement, the Seller agrees to forgo their right to remuneration, compensation, legal or contractual action against the Agent(s) and/or the Brokerage, for the omission of such services.
