Gross misconduct is misconduct so serious that it constitutes a fundamental breach of the contract of employment and would make continuation of the employment relationship intolerable. This justifies summary dismissal (i.e. dismissal without notice or pay in lieu of notice)
Some examples of gross misconduct include, but are not limited to:
dishonesty
serious breach of confidence
theft or fraudulently claiming payment for work not done, expenses, sick pay, etc.
deliberate falsification of records
violence, fighting, physical assault or extreme insulting behaviour
harassment
malicious damage to company, customer, or colleague's property
leaving your place of work without permission or without sufficient cause
conduct in a manner likely to bring discredit to RUSH, clients or fellow employees
being unfit for work through alcohol or drugs, including smelling of intoxicating liquor
failure to notify us of any criminal conviction, police caution or being summoned or charged with any offence
conviction of an offence
use of our equipment or facilities without permission
serious cases of non-compliance with health & safety
causing damage to RUSH or customer's property or failing to report damage
Assault or verbal abuse of customer, colleagues or management
refusal to carry out a reasonable instruction
using offensive language
refusal to carry out your shift, or change from one to another at our discretion
jeopardising or interfering with the RUSH/customer relationship
Gross misconduct offences will be dealt with in the same way as any other disciplinary process, however we may suspend you.
